<br />3. lf all or an}' part of the Properly or an�� lnterest in the Properl�� is sold ur transfen•ed (or if Borrowcr is not a
<br />natural person and a beneticial interest in Borrow�er is sold or transferred) without Lender's prior ��ritten consent,
<br />Lender may require immediate payment in full of all sums secureJ by the Security Instrument.
<br />lf Lender exercises this option, Lender shall give Borrower notice of lcceleration. 'The natice sh�ill provide a
<br />period of not less than 30 days from the date the notice is delivered or mailed «�ithin �vl�ich Borrower must pa�� all
<br />sums secured by the Secueity instrument. If Borrower fails to pay these sums prior to the e�piralion of this
<br />period, Lender may invoke any remedies perniitted by the Security Instrument without fm•ther nolice or demand
<br />on Borrower.
<br />4. Boreower also will comply with all other covenants, agreements, and reyuirements of the Security Instivment,
<br />including without limitation, Borrower's covenanL� and agrcemenls to make all payments of ta�es, insurance
<br />premiums, assessments, escro�i� items, impounds, and all other payments that Bon�ower is ohligated to mal;e
<br />under the Security (nstrument; however, the i'ollowing tcrms and provisions are forever canceled, null and void.
<br />as of the date specified in paragraph No. I above:
<br />(a} all terms and provisions oi'the Note and Secueity Instrument (i1'any) providing for, implementing, or relating
<br />to, any change or adjustment in the rate of' interest pay�able under the Note, including, w�here applicable, the
<br />"Timely Payment Rewards rate reduction, as described in paragraph 1 of the Timely Payment Rewards
<br />Addendum to Note and paragraph A.I of the 'I'imely }'ayment Rc���ards Rider. By esecuting this Agreemenl,
<br />Borrower waives any Timely Pay�ment Re«�ards rate reduction to which Borro�•er may have othenvise been
<br />entitled; and
<br />(b) all terms and provisions of any adjustable rate rider or Timely Pa}'ment Rc�vards Rider, where applicable, or
<br />other instrument or document that is aftixed to, ��holly or partially incorporated into, or is part of, the Note or
<br />Security (nstrument and that contains any such terms and provisions as those referred to in (a) above.
<br />$. Borrower understands and agrees that
<br />(a) All the rights and remedies, stipulations, and conditions contained in the Securit} Instrument rclating to
<br />default in the mal:ing of pa}•men[s under the Security Instrumenl shall also apply to default in the mahing af
<br />the modified payments hereunder.
<br />(b1 All covenants, agreements, stipulations, and conditions in the Note and Security Instrument shall be and
<br />remain in full force and effect, except as herein moditied, and none of the Borrower's obligations or liabilities
<br />under the Note and Security• Instrument shall be diminished or released b�� any provisions hereot; nor shall
<br />this Agreement in any �vay impair, diminish, or aflect any of' I,ender's rights under or remedies on the Note
<br />and Security Instrument, whether such rights or remedies urise thereunder or by operation of law. Also, all
<br />rights of recourse to which Lender is presently entitled against any property or any other persons in any
<br />�vay obligated for, or liable on, the Note and Security Insuvmcnt are expressly reserved by I,ender.
<br />(c} Nothing in this Agreement shall be understood or construed to be a satisfaction or release in whole or in
<br />part of the Note and Security Instrument.
<br />(d) All costs and expenses incurred by Lender in connection with this Agreement, including recording fees, title
<br />examination, and attorney's fees, shall be paid by thc Borru��er and shall be secured by the Security
<br />Instrument, unless stipulated othcrwise by I,ender.
