RESOLUTION #22- 01 <br /> A RESOLUTION RENEWING THE CONDITIONAL USE OF PART OF THE NORTHWEST QUARTER OF <br /> THE NORTHEAST QUARTER (NW1/4NE1/4) OF SECTION THIRTY (30), TOWNSHIP TEN (10) <br /> NORTH, RANGE TEN (10) WEST OF THE 6T" P.M., HALL COUNTY, NEBRASKA <br /> WHEREAS, Mid-Nebraska Aggregate, Inc., hereinafter referred to as "applicant," is the licensee <br /> with respect to the following described real estate, to-wit: <br /> PART OF THE NORTHWEST QUARTER OF THE NORTHEAST QUARTER (NW1/4NE1/4) OF <br /> SECTION THIRTY (30)TOWNSHIP TEN (10) NORTH, RANGE TEN (10) WEST OF THE 6111 P.M., HALL <br /> COUNTY, NEBRASKA; and <br /> WHEREAS, Ron Follmer, hereinafter referred to as "owner," is the record title owner of the <br /> above-described real estate; and <br /> WHEREAS, the above described real estate is located within the AG-R Zoning District; and <br /> WHEREAS, Applicant has presented a renewal application for a Conditional Use Permit to the <br /> Hall County Board of Commissioners requesting a Conditional Use Permit for a temporary <br /> asphalt batching plant; and <br /> WHEREAS, on February 15 , 2022, a Public Hearing on said application was held at the <br /> regular meeting of the Hall County Board of Commissioners following notice of the same as <br /> provided by statute; and <br /> WHEREAS, The Hall County Board of Commissioners finds that such use is authorized under the <br /> Conditional Uses within the AG-R District that such use, as limited herein, will not adversely <br /> affect the public interest and that said Board is empowered under the Zoning Resolution to <br /> permit such conditional use. <br /> NOW, THEREFORE, the Hall County Board of Commissioners grants to Applicant a Conditional <br /> Use Permit to use the above described real estate for a Temporary Asphalt Batching Plant <br /> SUBJECT TO THE FOLLOWING CONDITIONS, RESTRICTIONS AND LIMITATIONS upon the use of <br /> the aforesaid property by Applicant and Owner, and their permittees, licensees, tenants and <br /> contractors: <br /> 1. This Conditional Use Permit shall be in conjunction with an existing Conditional Use <br /> Permit for Pumping of Sand and Gravel on the same land and subject to all of the existing terms <br /> and conditions of said permit. <br /> 2. Applicant shall erect and maintain traffic control devices, at a minimum, prior to all <br /> curves and place a flashing barricade at the entrance to the driveway, or as shall otherwise be <br /> required/permitted by the Nebraska Department of Roads. <br />
