RESOLUTION #22- 01 A RESOLUTION RENEWING THE CONDITIONAL USE OF PART OF THE NORTHWEST QUARTER OF THE NORTHEAST QUARTER (NW1/4NE1/4) OF SECTION THIRTY (30), TOWNSHIP TEN (10) NORTH, RANGE TEN (10) WEST OF THE 6T" P.M., HALL COUNTY, NEBRASKA WHEREAS, Mid-Nebraska Aggregate, Inc., hereinafter referred to as "applicant," is the licensee with respect to the following described real estate, to-wit: PART OF THE NORTHWEST QUARTER OF THE NORTHEAST QUARTER (NW1/4NE1/4) OF SECTION THIRTY (30)TOWNSHIP TEN (10) NORTH, RANGE TEN (10) WEST OF THE 6111 P.M., HALL COUNTY, NEBRASKA; and WHEREAS, Ron Follmer, hereinafter referred to as "owner," is the record title owner of the above-described real estate; and WHEREAS, the above described real estate is located within the AG-R Zoning District; and WHEREAS, Applicant has presented a renewal application for a Conditional Use Permit to the Hall County Board of Commissioners requesting a Conditional Use Permit for a temporary asphalt batching plant; and WHEREAS, on February 15 , 2022, a Public Hearing on said application was held at the regular meeting of the Hall County Board of Commissioners following notice of the same as provided by statute; and WHEREAS, The Hall County Board of Commissioners finds that such use is authorized under the Conditional Uses within the AG-R District that such use, as limited herein, will not adversely affect the public interest and that said Board is empowered under the Zoning Resolution to permit such conditional use. NOW, THEREFORE, the Hall County Board of Commissioners grants to Applicant a Conditional Use Permit to use the above described real estate for a Temporary Asphalt Batching Plant SUBJECT TO THE FOLLOWING CONDITIONS, RESTRICTIONS AND LIMITATIONS upon the use of the aforesaid property by Applicant and Owner, and their permittees, licensees, tenants and contractors: 1. This Conditional Use Permit shall be in conjunction with an existing Conditional Use Permit for Pumping of Sand and Gravel on the same land and subject to all of the existing terms and conditions of said permit. 2. Applicant shall erect and maintain traffic control devices, at a minimum, prior to all curves and place a flashing barricade at the entrance to the driveway, or as shall otherwise be required/permitted by the Nebraska Department of Roads.
