BE IT FURTHER RESOLVED that the Hall County Board of Commissioners hereby <br /> grants Werner Construction, Inc. a ten (10) year extension and renewal of the aforementioned <br /> Conditional Use Permit, said renewal and extension commencing forthwith and terminating on <br /> December 31, 2030, to use the Property for the mining and pumping of sand and gravel from the <br /> land SUBJECT TO THE FOLLOWING CONDITIONS, LIMITATIONS, AND <br /> RESTRICTIONS: <br /> (a) Pumping of sand and gravel and storage of recyclable road construction materials <br /> shall not be allowed within 300 feet of the public road right of way or easement. <br /> (b) Pumping and other activities including, but not limited to, lighting, hauling, <br /> loading, unloading, sorting, and processing, is permitted from fifteen minutes after <br /> sunrise to fifteen minutes after sunset Mondays through Saturdays. No pumping or <br /> other activities are permitted on Sundays or from fifteen minutes after sunset to <br /> fifteen minutes after sunrise. <br /> (c) If Applicant believes an emergency exists, Applicant may request permission to <br /> allow 24-hour use. The Zoning Director is given the authority to allow such use <br /> until the matter can be presented to the County Board. The Zoning Director will <br /> notify the Board Chair as soon as possible of any emergency operation request and <br /> whether permission was granted. <br /> (d) Any internal combustion pump motors utilized shall be equipped with a <br /> functioning "hospital grade muffler" designed to reduce exhaust noise by 32 to <br /> 40 decibels. <br /> (e) Materials and equipment shall not be stored on the property within the regulated <br /> floodways as determined by the Federal Emergency Management Agency or its <br /> successor and the entity having jurisdiction and authority to enforce flood plain <br /> regulations. <br /> (f) All dead trees, rubbish and debris, if any, must be cleared from the above described <br /> real estate as soon as practical and said real estate must, at all times, be kept in a <br /> clean and neat condition; Applicant will seasonally mow the Property in order to <br /> abate the growth of vegetation visible from Engleman Road. <br /> (g) No trash, rubbish, debris, broken concrete, dead trees, lumber, blocks, refuse <br /> or junk material of any nature whatsoever shall be dumped, placed or located upon <br /> said real estate. <br /> (h) Recyclable road construction materials, milled or crushed off-site to a particle size <br /> consistent with native aggregates found at the site, may be stored or kept at its <br /> current location or on the aforesaid Lot Three (3), but the total quantity of such <br /> materials stored annually on the following described real estate owned, leased, <br /> controlled, occupied, or used by Applicant or Owner shall not exceed 50,000 tons by <br />
