volume, to wit: <br /> Lots One (1) and Two (2) North of the half section line and Lot Three (3), Section Ten <br /> (10), Township Ten (10) North, Range Ten (10) West of the 6th P.M., Hall County, <br /> Nebraska, and <br /> The East Half of the Southeast Quarter(E 1/2 SE 1/4) and that part of Lot Two (2) on <br /> Island south of the half section line, Section Ten (10), Township Ten(10)North, Range <br /> Ten(10) West of the 6th P.M., Hall County,Nebraska. <br /> (i) Crushing or grinding of aggregate other than those mined on site shall not be <br /> permitted. <br /> (j) Manufacturing uses including, but not limited to, asphalt or Portland cement based <br /> concrete production, shall not bepermitted. <br /> (k) Applicant shall not use said real estate in such a way so as to create or result in an <br /> unreasonable hazard or nuisance to adjacent landowners or to the general public. <br /> (1) Applicant shall maintain any and all drainage ditches that may be located upon the <br /> real property. <br /> (m) Applicant shall not permit the hauling of sand and gravel from the premises and <br /> over and across any public highway or road unless said sand and gravel is <br /> completely dry and free of water or is hauled in trucks which are designed and <br /> equipped so as to prevent water from leaking onto the traveled po 1 tion of the <br /> roadbed. <br /> (n) All water accumulated upon the premises by virtue of such mining and pumping <br /> operations shall be retained upon the premises and shall not flow upon or encroach <br /> upon any adjacent land. Only surface waters that have historically flowed from the <br /> premises shall be permitted to leave the same through historical natural drainage <br /> ways. <br /> (o) The term of this conditional use permit shall be for a period of ten (10) years <br /> beginning March 17, 2020. This permitted conditional use shall terminate on <br /> December 31, 2030 but may be sooner terminated if Applicant fails to comply with <br /> any of the conditions, restrictions and obligations set forth herein. The County <br /> Board of Commissioners or its designee may inspect the premises for compliance at <br /> least twice every 12 months or may request, and Applicant will provide, written <br /> documentation of the volume of materials at the permit site. Applicants agree to <br /> permit said inspectors to enter upon the Property for such purposes upon reasonable <br /> notice provided by the Hall County Board of Commissioners, or its designee.
