BOARD OF COMMISSIONERS <br /> HALL COUNTY <br /> RESOLUTION#20-p39 <br /> A RESOLUTION AUTHORIZING OF A CONDITIONAL USE OF A PART OF THE <br /> EAST HALF OF THE SOUTHEAST QUARTER(E '/ZSE%)AND LOTS 1,2 AND 3 ON <br /> ISLAND,ALL IN SECTION TEN(10),TOWNSHIP TEN NORTH (TION),RANGE TEN <br /> WEST(MOW)OF THE 6TH P.M.,HALL COUNTY NEBRASKA <br /> WHEREAS, Werner Construction, Inc., as the tenant and/or licensee, hereinafter <br /> referred to as "Applicant," has made application for a conditional use permit for the <br /> conditional use of the following-described real estate, to wit: The East half of(E1/2) of the <br /> Southeast Quarter (SE 1/4) and Lots 1, 2, and 3 on the Island in Section(10),Township Ten <br /> (10)North,Range Ten(10)West of the 6th P.M., Hall County, Nebraska ("the Property"); <br /> and <br /> WHEREAS, said property is located within the AGR-1 Zoning District; and <br /> WHEREAS, Emil & Beverly Schaaf are the owners of the Property; and <br /> WHEREAS, Werner Construction, Inc. possesses a leasehold interest in the <br /> Property; and <br /> WHEREAS, Werner Construction, Inc.has presented an application to the Hall <br /> County Board of Commissioners for the extension and renewal of Conditional Use Permits <br /> for the pumping of sand and gravel from the Property as heretofore authorized by <br /> Resolution#10-38, Resolution #10-19, Resolution #04-22, and Resolution #00-63; and <br /> WHEREAS, Werner Construction, Inc. seeks a conditional use permit for gravel and <br /> sand extraction operations for a duration of ten years; and <br /> WHEREAS, the Hall County Board of Commissioners seeks to promote economic <br /> activity within Hall County that contributes to Hall County's tax base with minimal <br /> disruption to the residents in the vicinity of such activity; and <br /> WHEREAS, on March 3, 2020, following due and proper notice, the Hall County Board <br /> of Commissioners held a public hearing upon said renewal application; <br /> NOW, THEREFORE, BE IT RESOLVED that, upon consideration of the evidence <br /> presented and the factors to be considered pursuant to the zoning regulations, the use of the <br /> aforesaid property for pumping of sand and gravel is found to be consistent with the intent <br /> of the AGR-1 Zoning District, that such use will not adversely affect the public interest, and <br /> that said Board is empowered to permit such conditional use; <br />
