RESOLUTION# 19- <br /> A RESOLUTION TO RENEW A CONDITIONAL USE PERMIT <br /> FOR THE USE OF LOT ONE (1) IN WILHELMI SUBDIVISION, <br /> HALL COUNTY,NEBRASKA <br /> WHEREAS,Aurora Cooperative Elevator Company,hereinafter referred to as Aapplicant,@ is the lessee of <br /> the following-described real estate,to-wit: <br /> Lot One(1) in Wilhelmi Subdivision, Hall County,Nebraska; and <br /> WHEREAS, applicant has made written application to use the above-described property for the storage in <br /> bulk of liquid propane and fertilizer and for storage of propane and fertilizer tanks and equipment related to <br /> the business operation of retail propane and fertilizer sales; and <br /> WHEREAS, the above-described property is located in a district presently zoned for AG-1 Agricultural <br /> use; and <br /> WHEREAS, the proposed conditional use in a district zoned AG-1 is a permitted conditional use pursuant <br /> to section 5, paragraph 1.c. of the Zoning Resolution of Hall County,Nebraska, as amended; and <br /> WHEREAS, on November 26, 2019, a public hearing on said application was held by the Hall County <br /> Board of Supervisors upon due and proper notice of said hearing; and <br /> WHEREAS, at said public hearing the public was given the opportunity to speak in favor of and in <br /> opposition to the application for conditional use; and <br /> WHEREAS, the Hall County Board of Supervisors finds that such use is authorized under the conditional <br /> uses within the AG-1 District; that such use, as limited herein, will not adversely affect the public interest; <br /> and that said Board is empowered under the Zoning Resolution to permit such conditional use. <br /> NOW BE IT RESOLVED that pursuant to the Zoning Resolution of Hall County, Nebraska, the Hall <br /> County Board of Supervisors hereby authorizes the conditional use of the above-described property for the <br /> storage in bulk of liquid propane and fertilizer and for storage of propane and fertilizer tanks and equipment <br /> related to the business operation of retail propane and fertilizer sales subject to the following conditions: <br /> 1. The above-described real estate shall be used solely for the storage in bulk of liquid propane and <br /> fertilizer and for storage of propane and fertilizer tanks and equipment related to the business operation of <br /> retail propane and fertilizer sales. The real estate shall be enclosed by a wire mesh fence with suitable <br /> gates and locks thereon to prevent access by unauthorized persons. The premises shall be maintained in a <br /> neat and clean condition at all times, free of debris and inflammable waste materials. <br /> 2. Applicant shall comply with the Hall County Zoning Resolution with respect to the use of the <br /> above-described property. <br /> 3. The rights and privileges granted herein may be terminated for any act or acts of noncompliance with <br /> the terms and conditions of this resolution. The Hall County Board of Supervisors shall provide written <br /> notice to Applicant of any act or acts constituting noncompliance. Applicant shall have 14 days to cure <br /> such noncompliance. In the event Applicant fails to cure such noncompliance, the Hall County Board of <br /> Supervisors may terminate or revoke the rights and privileges granted herein. <br />
