RESOLUTION#19- 1 11 3 <br /> A RESOLUTION AUTHORZING THE CONDITIONAL USE OF PART OF THE SOUTH <br /> ONE-HALF OF THE SOUTHEAST ONE-FOURTH OF SECTION SEVEN (7), TOWNSHIP <br /> ELEVEN (11),RANGE ELEVEN (11) WEST OF THE 6TH P.M., HALL COUNTY <br /> NEBRASKA <br /> WHEREAS, Rise Broadband has made an application for a conditional use permit for the <br /> conditional use of the following-described property for the erection,operation,and maintenance of an <br /> internet tower having a height of 80 feet, all upon the following-described real estate, to-wit: <br /> PART OF THE SOUTH ONE-HALF OF THE SOUTHEAST ONE-FOURTH OF SECTION <br /> SEVEN(7), TOWNSHIP ELEVEN(11), RANGE ELEVEN(11) WEST OF THE 6TH P.M.,HALL <br /> COUNTY, NEBRASKA; and <br /> WHEREAS, a public hearing regarding said application was held on the 17th day of <br /> September, 2019, after due and proper notice of same being afforded the public; and <br /> WHEREAS, the said property is located within the AG-1 Zoning District; and <br /> WHEREAS, the Hall County Board of Supervisors is empowered under the Hall County <br /> Zoning Resolution to grant a permit for the conditional use of the property for development and <br /> maintenance of a tower within the AG-1 Zoning District. <br /> NOW,THEREFORE,BE IT RESOLVED that the application for a conditional use permit for <br /> the conditional use of the above-described real estate for the above-stated uses should be and hereby <br /> is approved subject to the following conditions: <br /> 1. Maintenance. The premises shall at all times be maintained in a neat and orderly <br /> condition. The towers, antenna support structures, and antennas shall at all times be <br /> kept and maintained in good condition, order and repair so that the same does not <br /> constitute a nuisance to or a danger to the life or property of any person or the public. <br /> 2. Noxious Weeds. Noxious weeds on the premises shall be controlled pursuant to state <br /> and local laws and regulations. <br /> 3. FAA and FCC Compliance. The tower owner shall comply with all applicable rules <br /> and regulations of the Federal Aviation Administration regarding the construction, <br /> height, design and maintenance of the internet tower placed upon the above-described <br /> real estate and applicable rules of the Federal Communications Commission regarding <br /> the use of the tower and antennas. <br /> 4. Tower Use. Said tower shall be used for internet communication purposes only. <br /> 5. Tower Construction Standards. Said tower shall conform to all construction <br /> standards set forth in the County Zoning Resolution, federal and state law, and <br /> applicable American National Standards Institute (ANSI) standards. Upon completion <br /> of construction of a tower and prior to the commencement of use, an engineer's <br /> certification that the tower is structurally sound and in conformance with all of the <br /> aforementioned applicable regulatory standards shall be filed with the Zoning <br /> Department. <br /> 6. Permits. Applicant must obtain and maintain in good standing all construction and <br /> electrical permits necessary for the tower site. <br />
