RESOLUTION#19- 1 11 3 A RESOLUTION AUTHORZING THE CONDITIONAL USE OF PART OF THE SOUTH ONE-HALF OF THE SOUTHEAST ONE-FOURTH OF SECTION SEVEN (7), TOWNSHIP ELEVEN (11),RANGE ELEVEN (11) WEST OF THE 6TH P.M., HALL COUNTY NEBRASKA WHEREAS, Rise Broadband has made an application for a conditional use permit for the conditional use of the following-described property for the erection,operation,and maintenance of an internet tower having a height of 80 feet, all upon the following-described real estate, to-wit: PART OF THE SOUTH ONE-HALF OF THE SOUTHEAST ONE-FOURTH OF SECTION SEVEN(7), TOWNSHIP ELEVEN(11), RANGE ELEVEN(11) WEST OF THE 6TH P.M.,HALL COUNTY, NEBRASKA; and WHEREAS, a public hearing regarding said application was held on the 17th day of September, 2019, after due and proper notice of same being afforded the public; and WHEREAS, the said property is located within the AG-1 Zoning District; and WHEREAS, the Hall County Board of Supervisors is empowered under the Hall County Zoning Resolution to grant a permit for the conditional use of the property for development and maintenance of a tower within the AG-1 Zoning District. NOW,THEREFORE,BE IT RESOLVED that the application for a conditional use permit for the conditional use of the above-described real estate for the above-stated uses should be and hereby is approved subject to the following conditions: 1. Maintenance. The premises shall at all times be maintained in a neat and orderly condition. The towers, antenna support structures, and antennas shall at all times be kept and maintained in good condition, order and repair so that the same does not constitute a nuisance to or a danger to the life or property of any person or the public. 2. Noxious Weeds. Noxious weeds on the premises shall be controlled pursuant to state and local laws and regulations. 3. FAA and FCC Compliance. The tower owner shall comply with all applicable rules and regulations of the Federal Aviation Administration regarding the construction, height, design and maintenance of the internet tower placed upon the above-described real estate and applicable rules of the Federal Communications Commission regarding the use of the tower and antennas. 4. Tower Use. Said tower shall be used for internet communication purposes only. 5. Tower Construction Standards. Said tower shall conform to all construction standards set forth in the County Zoning Resolution, federal and state law, and applicable American National Standards Institute (ANSI) standards. Upon completion of construction of a tower and prior to the commencement of use, an engineer's certification that the tower is structurally sound and in conformance with all of the aforementioned applicable regulatory standards shall be filed with the Zoning Department. 6. Permits. Applicant must obtain and maintain in good standing all construction and electrical permits necessary for the tower site.
