7. Colocation of Antennas. The tower shall be designed and constructed so as to permit <br /> colocation of additional antennas as described in Paragraph 8 below. <br /> 8. Colocation of Emergency Service Antennas. The tower owner shall permit <br /> colocation of Hall County emergency service antennas as provided in the County <br /> Zoning Resolution. <br /> 9. Setback. The tower shall meet applicable setbacks as provided in the County Zoning <br /> Resolution. <br /> 10. Lighting. The tower shall not be artificially lighted unless required by the Federal <br /> Aviation Administration. <br /> 11. Security. The tower shall be enclosed within a security fence or other structure <br /> designed to preclude unauthorized access or shall be designed and constructed in a <br /> manner which will preclude to the extent practical, unauthorized climbing of said <br /> structure. <br /> 12. Signs. No signs shall be allowed on any antenna or tower. <br /> 13. Inspection. The County reserves the right to conduct an inspection of towers, antenna <br /> support structures, and antennas upon reasonable notice to the tower owner or operator <br /> to determine compliance with this Resolution and to prevent structural and equipment <br /> failures and accidents which may cause damage, injuries or nuisances to the public. <br /> Inspections may be made to determine compliance with the construction standards set <br /> forth in the County Zoning Resolution, federal and state law or applicable ANSI <br /> standards. <br /> 14. Abandonment. If the tower shall cease to be used for a period of three hundred <br /> sixty-five (365)consecutive days, Hall County shall notify the tower owner that the site <br /> will be subject to a determination that the site has been abandoned. Upon issuance of a <br /> Notice to Show Cause by Hall County, the tower owner shall have thirty (30) days to <br /> show by a preponderance of the evidence that the tower has been in use or under repair <br /> during the period of apparent abandonment. In the event the tower owner fails to show <br /> that the tower has been in use or under repair during the relevant period, Hall County <br /> shall issue a final determination of abandonment of the site and the tower owner shall <br /> have seventy-five (75) days thereafter to dismantle and move the tower. <br /> 15. Term. The term of the permit shall be for a period of five (5) years from the date <br /> hereof unless terminated pursuant to Paragraphs 13 or 15. This permit shall run with <br /> the land during the permit's duration and may be transferred,conveyed,and assigned by <br /> the applicant to assigns and successors-in-interest. <br /> 16. Termination of Permit. The County of Hall, Nebraska may terminate this permit in <br /> the event that tower owner fails to comply with any of the conditions, restrictions, and <br /> obligations set forth herein. The Hall County Board of Supervisors shall notify the <br /> tower owner in writing setting forth the specific area of noncompliance. If the tower <br /> owner fails to take reasonable action to comply with the notice of noncompliance and <br /> correct any or all violations within 30 days after receiving said notice, the Hall County <br /> Board of Supervisors shall hold a hearing to consider the revocation and termination of <br /> the Conditional Use Permit by majority vote. <br />
