RESOLUTION#19- S A RESOLUTION GRANTING A CONDITIONAL USE PERMIT FOR THE USE OF A TRACT OF LAND BEING PART OF THE NORTHEAST QUARTER OF THE NORTHEAST QUARTER(NE 1/4 NE 1/4) OF SECTION THIRTY-ONE (31), TOWNSHIP TEN (10)NORTH, RANGE ELEVEN (11)WEST OF THE SIXTH PRINCIPAL MERIDIAN, HALL COUNTY,NEBRASKA; APPLICATION OF NE COLORADO CELLULAR, INC.,DBA VIAERO WIRELESS WHEREAS, NE Colorado Cellular, Inc., dba Viaero Wireless, hereinafter referred to as the "Applicant," has made an application for renewal of a Conditional Use Permit pursuant to the Hall County Zoning Resolution for the conditional use of the following described property for the erection, operation and maintenance of a 195 foot self-supporting communications tower and an associated equipment shelter all upon the following described property, to-wit: A tract of land being part of the Northeast Quarter of the Northeast Quarter(NE 1/4 NE 1/4) of Section Thirty-one (31), Township Ten (10) North, Range Eleven (11) West of the Sixth Principal Meridian, Hall County, Nebraska, more particularly described as follows: Referring to the Northeast corner of said Section 31 and assuming the North line of said Northeast Quarter as bearing S 89°59'24"W and all bearings contained herein are relative thereto; thence S 89°59'24" on said North line a distance of 45.0 feet to the ACTUAL PLACE OF BEGINNING,said place of beginning being on the West right-of-way line of Nebraska State Highway No. 11; thence S 00°33'32 W on said West right-of-way line a distance of 438.0 feet;thence S 89°59'43"W a distance of 464.95 feet to the Southeast corner of a tract of land as described in Book 178 of Deeds, page 17 and recorded in the Hall County Register of Deeds; thence N 00°10'30" E on the East line of said tract a distance of 302.79 feet to the Northeast corner of said tract and being on the North line of said Northeast Quarter; thence N 89°59'24" E on said North line a distance of 917.89 feet to the place of beginning, containing 7.319 acres more or less, of which 0.661 acres, more or less, are presently being used for road purposes on the north side; and WHEREAS, a public hearing regarding said application was held by the County Board of Supervisors of Hall County, Nebraska on August 20, 2019 after due and proper notice of same being afforded the public; and WHEREAS,the said property is located within the AG-1 Agricultural Zoning District; and WHEREAS, the Hall County Board of Supervisors is empowered under the Zoning Resolution to grant a Conditional Use Permit for the conditional use of property for development of a tower within the AG-1 Agricultural District. NOW BE IT RESOLVED that the renewal Application for Conditional Use Permit for the conditional use of the above-described property for the above-stated uses be and is hereby approved subject to the following conditions: 1. Maintenance. The premises shall at all times be maintained in a neat and orderly condition. The towers, antenna support structures, telecommunications facilities and antennas shall at all times be kept and maintained in good condition, order and repair so
