RESOLUTION #19- I EC) <br /> A RESOLUTION AUTHORZING SMART SOIL LLC THE CONDITIONAL USE OF A <br /> PART OF THE SOUTHEAST QUARTER(SE1/4) OF SECTION NINETEEN (19), <br /> TOWNSHIP ELEVEN (11) NORTH, RANGE ELEVEN (12) WEST OF THE <br /> 6TH P.M., HALL COUNTY, NEBRASKA. <br /> WHEREAS, Smart Soil LLC has made an application for a conditional use permit for the <br /> conditional use of the following-described property for the purpose of a composting site, all upon the <br /> following-described real estate, to-wit: <br /> THE SOUTHEAST QUARTER (SE1/4) OF SECTION NINETEEN (19), IN TOWNSHIP <br /> ELEVEN (11) NORTH, RANGE TWELVE (12), WEST OF THE 6TH P.M. IN HALL COUNTY, <br /> NEBRASKA; and <br /> WHEREAS, a public hearing regarding said application was held on the 23rd day of July, <br /> 2019, after due and proper notice of same being afforded the public; and <br /> WHEREAS, the said property is located within the A-1 Agricultural Zoning District; and <br /> WHEREAS, the Hall County Board of Supervisors is empowered under the Hall County <br /> Zoning Resolution to grant a permit for the conditional use of the property for a composting site in the <br /> A-1 Agricultural Zoning District. <br /> NOW,THEREFORE, BE IT RESOLVED that the application for a conditional use permit for <br /> the conditional use of the above-described real estate for the above-stated uses should be and hereby <br /> is approved subject to the following conditions: <br /> Term—This permit allows a 90-day trial period beginning on the date of delivery of the first load of <br /> nitrogen-based compost material. The trial period is to allow at least two composting cycles, ideally <br /> three 30-day composting cycles. A new public hearing regarding this conditional use permit will be <br /> held as soon as practicable after the trial period, but no later than the first regularly scheduled board <br /> following a 30-day period after the end of the test period. If approved, this permit may be extended <br /> to coincide with Smart Soil LLC's Nebraska Department of Environment and Energy Operating <br /> Permit. <br /> The 90-day trial permit is subject to the following conditions: <br /> Sign—a sign will be placed at the trial site. The sign will be 18"x24", having a yellow or white <br /> background, and black lettering 2 1/2 inches tall. The sign will contain contact information for the <br /> Facility and Zoning Director and for a representative from Smart Soil LLC. <br /> Committee/Surveys—A committee has been invited to make observations and give feedback <br /> regarding the 90-day trial. Members of the public,including residents in the area of the compost site, <br /> have been invited to participate with the committee. The committee consists of members of the <br /> public, County Board members, and county staff. The committee will be given the opportunity to <br /> visit the site routinely and fill out surveys regarding their observations. The surveys will be collected <br /> by the Zoning Director's office and provided to the County Board for consideration at the public <br /> hearing. <br />
