12. FACILITIES —A) DISCUSSION AND POSSIBLE ACTION ON CONDITIONAL USE <br /> PERMIT FOR 90 DAY TRIAL FOR SMART SOIL LLC — Mr. Humphrey and Chad Nabity stated <br /> that Mr. Woitaszewski met and they have set up the guidelines for the 90 day trial period and it <br /> would be the same permit if it is approved for a longer period. It is not as stringent as it would be <br /> for a full operation. They will have 2 days of paunch and 21 to 30 days to process. It would <br /> allow 3 opportunities to test it and then at the end of the 90 days they would hold a new public <br /> hearing for a conditional use permit. At that hearing the evidence would be brought forward and <br /> if the conditions have been met it would be considered again. It is a smaller site and there <br /> would be a smaller barrier and the water would be kept on the site. The engineer will design the <br /> barrier according to the DEQ regulations and there would be no additional permitting required. <br /> It was ask if the water could leach out and what if there was a lot of flooding. <br /> Lancaster note this product is used for fertilizer, this is an agricultural area and the question is if <br /> the county will allow the 90 day trial under the conditions and parameters set forth in the <br /> resolution. <br /> Hartman expressed concern that if it is there for 90 days it will be there. <br /> Quandt noted that other counties have the same issues and Merrick County is applying this <br /> product. They are watching what Hall County is doing and the test plot is the best way to <br /> determine what it will be like. The neighbors will have a say and it will be done right and at the <br /> end of the 90 days it will be decided. JBS is a large employer and it is important to the <br /> community to make sure it works under the conditions. <br /> Quandt made a motion and Bredthauer seconded to approve the Resolution #19-150 for the <br /> conditional use permit for Smart Soil LLC for the 90 day trial period. Deputy County Attorney <br /> Sarah Carstensen noted that the survey will be collected and the compilations of the findings <br /> will be given to the county board. <br /> Quandt stated that there will be 3 supervisors on the committee. <br /> The vote on the motion was taken. Bredthauer, Lancaster, Quandt, and Peterson voted yes. <br /> Hurst abstained Richardson and Hartman voted no. Motion carried. <br /> Lancaster stated that she has not made a final decision and is interested in the results. This is <br /> a serious consideration and she wants to see the results from the trail period. <br /> 6 <br />
