DISCUSSION & POSSIBLE ACTION REGARDING TERC APPEAL FOR <br /> SUBCLASS OF COMMERCIAL PROPERTY- Lancaster stated that after the Board of <br /> Equalization formal hearings there was discussion regarding the downtown commercial <br /> properties. The new Marshall Swift pricing manual was ordered by the state to be <br /> implemented but the percentage of the deprecation was lowered to 80%. This was not <br /> based on sales or building permits or renovations. This increase was across the <br /> county. If the valuations were protested they could be addressed but if not there would <br /> be no recourse to address the new valuations. Lancaster stated that she discussed this <br /> with Jack Zitterkopf and asked him to address it. This is a difference of opinion and <br /> because of the concern they would like to address it. <br /> Jack Zitterkopf stated he received a call from Jan Pelland in relation to the Board of <br /> Equalization hearings and he was not sure what the board wanted to do. He read the <br /> state statutes 77-1504 to the county board stating that the county board can petition to <br /> address a class or sub class. They could petition TERC regarding all commercial <br /> property or all commercial [property in the down town area. Jan prepared a map and <br /> Jack described the area. The majority of the issues are in the confines of the map. <br /> Jack stated he has two petitions but they have to be filed with TERC today. <br /> Arnold stated he discussed this with Lancaster and most of the concern is on the uses <br /> of the upper stories down town. He noted that if the electrical and plumbing are not <br /> used they would have to bring it up to code. He also noted that many of the upper <br /> levels are vacant. This did affect all commercial buildings and he questioned if they <br /> should address the whole class. Discussion was held and this was not county wide it <br /> was the City of Grand Island. <br /> Quandt asked if Jan was able to get into all of the properties and she stated they could <br /> get into the main floor but could not get into only 10 to 20% of the buildings. <br /> Lanfear stated if they appeal then TERC would make the final decision. The down town <br /> is unique they have stores on the first level and some apartments above. <br /> Arnold stated that some of the apartments have been vacant for a long time. Down <br /> town is unique the buildings have dual occupancy. <br /> Quandt questioned how they could address the 80% depreciation issue. <br /> Arnold also expressed concern if there were even any sales. There are a few that are <br /> starting to make some renovations. <br /> Lancaster stated that is the responsibility of the Board of Equalization to address this <br /> issue. They may need to change the depreciation in order to spur development. <br /> 3 <br />
