He does not have the answer. <br /> Lancaster stated that the county did a good job establishing the equipment acquisition <br /> budget. This allows the board guide lines so the county has helped themselves. There <br /> are other counties that are going through this and there may be legislation regarding this <br /> issue and the ability to spend out of line items. The larger counties do support more <br /> guidelines. Hall County did a good job by establishing committees to address issues <br /> and if there are emergencies they are there to assist. <br /> Mr. Zitterkopf stated that the in the situation of the elected official versus the appointed <br /> the statutes and the case law are not clear but there is also the attorney general's <br /> opinion. So it is a good thing that the legislature may address this issue. <br /> Lancaster noted that there is now an attorney on the NACO Board. <br /> Mr. Zitterkopf stated that Mr. Quandt had an issue on the removal of the fence on the <br /> courthouse annex but was he authorized to do so and this was authorized by a <br /> committee of 3 elected officials. <br /> Arnold stated that he would like to take issue with the county purchasing act it isn't there <br /> to save money that is not the purpose, it is to keep the process honest this does not <br /> allow for the best price and sealed bids are not the best way to get the best price. If <br /> there are competitive quotes you can go back and forth between the bidders to get the <br /> best deal The act is to keep the prices open and honest and the board needs to <br /> evaluate was the purchase open honest and proper. If you look at the corrections and <br /> building and grounds committees they have best minutes to their meetings. The process <br /> is open and honest. <br /> Jeffries stated the county needs to be open and transparent as possible he thinks they <br /> do a god job. <br /> B. REQUEST FOR AUTHORITY TO RETAIN OUTSIDE LEGAL COUNSEL TO <br /> PERFORM AN "AUDIT" OF THE HALL COUNTY EMPLOYEE HANDBOOK. <br /> Mr. Zitterkopf stated that a year ago the handbook was approved. Michelle Oldham <br /> started that process and was almost completed when she left so he finished it. The <br /> original format was copy written for NIRMA by Pam Bourne an employment law attorney. <br /> Mr. Zitterkopf expressed concern that the original formant was amended and there are <br /> some things that the county does that are not required by law. He does not do <br /> employment law and it not a human resource director so cannot determine if the <br /> handbook is all correct. Now there are more investigators to audit FMLA etc so he sent <br /> a copy of the handbook to Pam Bourne to review. He would like to have her do the audit <br /> and red line what is wrong. The cost for this audit would be $2,000.0. He checked with <br /> Mark Young and he stated that he does not have it in his budget so he is requesting that <br /> the board approve this audit and the cost. <br /> Arnold stated that if it would save one claim it would be worth it. <br /> Arnold made a motion and Lancaster seconded to authorize Jack Zitterkopf to seek <br /> outside counsel to audit the Hall County Hand book. <br /> 4 <br />
