• <br /> The County Veterans Service Officer would report directly to <br /> the Veterans Service Committee and be responsible to them. The <br /> conditions of employment such as salary, holidays , sick pay, <br /> vacation time I conclude are set by the county board. I make this <br /> conclusion because of the very clear statutory authority of the <br /> board to set the salary of the Veterans Service Officer . The other <br /> forms of compensation that I listed are clearly tied into the <br /> salary of the Veterans Service Officer. <br /> This differs significantly from the elected officials <br /> situation. ' An, elected comity official is an independent office <br /> that is not responsible to the county board. The county board only <br /> sets the salary for an elected officials position prior to the <br /> people filing for the office_ Once that salary is set the county <br /> board has no control over the activities of that office . Several <br /> attorney general ' s opinions exist which set forth that the elected <br /> official sets the hours of their office , the holidays and all other <br /> compensation for their employees . This however is only altered by <br /> section 23-1114 which states that the county board sets the <br /> salaries for the deputies and conditions of their employment such <br /> as sick leave . This is the same statute that authorizes the county <br /> board to set the salary of the Veterans Service Officer . <br /> A closer comparison would be the Veterans Service officer to <br /> the appointed Highway Superintendent . The Highway Superintendent <br /> is appointed by the county board and serves at their will . All the <br /> conditions of his employment are established by the board. The <br /> County Highway Superintendent then in turn directs his employees <br /> according to guidance of the county board. The Veterans Service <br /> Officer would stand. in a similar position except for the fact that <br /> the Veterans Service Committee stands in between the Veterans <br /> Service Officer and the county board.. The Veterans service <br /> Committee would set the guidelines for the Veterans Service Officer <br /> such as manners of operation. The employees of the veterans <br /> service office ought to be considered county employees and treated <br /> the same as all other county employees . <br /> There are very few statutes and only one Attorney General ' s <br /> opinion , no case law that describes the relationship between the <br /> Veteran Service Officer, the Veterans Service Committee and the <br /> county board. What I have stated above is an interpretation of <br /> statutes to extrapolate a conclusion . Therefore , this is an <br /> expression of my opinion which is certainly subject to a second <br /> interpretation. <br />
