other causes; then he or she shall assume the defense of, and indemnify and save harmless <br /> owner from all claims of any kind arising from the performance of the contract. <br /> 11. Care of Property. The Contractor will protect the work,materials,property and adjacent <br /> property from damage or loss. The Contractor will also take proper precautions for the <br /> safety of the public. The Contractor will pay for, repair or replace any damage or loss <br /> caused by the Contractor's failure to perform this Contract. <br /> 12. Permits. The Contractor will obtain all building permits or approvals as required by law. <br /> The Contractor will pay for such permits. <br /> 13. Disposal. The Contractor will be responsible for the removal and disposal of all building <br /> debris, rubbish, and materials. All such items must be properly disposed in a licensed <br /> landfill. Copies of landfill receipts and/or recycling receipts shall be presented to Hall <br /> County Facilities Department. <br /> 14. Contractor's Continuing Liability. The Contractor will be liable for defective, faulty or <br /> improper materials or workmanship. Upon written demand, the Contractor will <br /> immediately remedy all defects, faults or omissions and complete all unfinished work. <br /> 15. Guarantee. Contractor does hereby warrant associated work, agreeing to repair or replace <br /> work that leaks water, deteriorates excessively, or otherwise fails to perform, due to failures <br /> of materials or workmanship. <br /> 16. Parties. This Contract shall be binding upon the County and the Owner and all parties who <br /> lawfully succeed to their rights and responsibilities. <br /> 17. Notices. All notices under this Contract must be in writing.
