CONTRACT <br /> This contract is made on this day of , 2018, between the County of Hall, <br /> hereinafter referred to as "County," and <br /> hereinafter referred to as "Contractor." <br /> 1. Agreement. The Contractor agrees to remove and dispose of old aluminum storm windows, <br /> scrap and clean old caulking, refurbish/paint the exterior of the interior windows and <br /> provide and install new aluminum windows per specifications on the Hall County <br /> Courthouse, 111 West First Street, Grand Island, Nebraska. <br /> 2. Work. The contractor shall provide all labor, materials, and equipment with all related <br /> services required to perform necessary work of window removal and replacement. <br /> The contractor shall be responsible for obtaining all necessary building permits and shall be <br /> responsible for the cost of necessary permits and disposal fees. <br /> 3. Location. All work will be completed on the property known as: Hall County Courthouse <br /> 111 West First Street, Grand Island, and Nebraska, hereinafter referred to as the "Property." <br /> 4. Consideration. The agreed upon consideration for the work is base <br /> contract price. <br /> 5. Materials. The Contractor will provide the materials, supplies, equipment, services and <br /> labor necessary for the complete performance of this Contract. Unless otherwise agreed, all <br /> materials will be new and of good quality. <br /> 6. Compliance with Laws. The Contractor will comply with all applicable Federal, State, and <br /> local laws regarding work, materials and the safety of persons or property. The County will <br /> not be responsible for any loss or damage to the work or any property of the Contractor. <br /> 7. No Oral Changes. This Contract can only be changed by an agreement in writing signed <br /> both by the County and the Contractor. No variations, alterations, deviations or extra work <br /> can be made unless both the County and the Contractor specifically agree in writing. <br /> 8. Failure to Complete Work. The Contractor must properly and diligently complete the work <br /> provided for in this Contract. <br /> 9. Payment. The County will pay the Contractor the base contract amount within 30 days of <br /> completion of the work to the County's reasonable satisfaction that said work was done in <br /> conformance with the contract and specifications. <br /> 10. Insurance and Indemnification. The Contractor shall maintain workers compensation <br /> insurance as required by law and full liability insurance with limits for personal injury of <br /> $1,000,000 dollars occurrence, $2,000,000 aggregate and auto and property damage limits <br /> of$1,000,000 with umbrella coverage of$5,000,000. A certificate or certificates of <br /> insurance substantiating such coverage for window painting and replacement shall be <br /> delivered to the County prior to the commencement of the work. Contractor shall take all <br /> responsibility for the work, shall bear all losses resulting to him or her on account of the <br /> amount or character of the work, or from any unforeseen obstructions or difficulties which <br /> may be encountered, or because the nature of the land in or on which the work is done is <br /> different from what is assumed or was expected, or on account of the weather, floods or <br />
