term of this Commercial Lease Agreement unless said repairs/replacements are caused by <br /> neglect of the Lessee which shall be the Lessee's obligation. Furthermore, except as otherwise <br /> provided herein, all repairs or replacements made necessary to the building itself, and excepting <br /> the fixtures and equipment which may be owned by the Lessee, which repairs or replacements <br /> are made necessary by reason of the happening of fire, vandalism or other casualty, shall be <br /> made by and at the expense of the Lessor;that at the termination of this Commercial Lease <br /> Agreement,the Lessee will deliver the Leased Premises in as good as condition as the same is <br /> taken by the Lessee or placed by Lessee or Lessor during the term of this Commercial Lease <br /> Agreement, reasonable wear and tear and damage by fire and other casualty excepted. <br /> 7. General Use of the Premises. The Lessee will use and occupy Leased Premises in <br /> a careful, safe and proper manner and will not commit or suffer any waste thereon, and will in all <br /> respects comply with all city and state laws and requirements of health authorities, particularly as <br /> to keeping the premises free and clear of all filth, refuse and obstruction; the Lessee will not <br /> permit any noise or nuisance whatever on the Leased Premises, or to do or permit anything on <br /> and about said Leased Premises which will increase the rate of insurance and that the Lessor and <br /> their agents may at all times enter upon the Leased Premises for the purpose of inspecting the <br /> same or for any other necessary purpose and that the Lessee will pay promptly when due all <br /> taxes levied or assessed on any and all improvements, equipment, and personal property owned <br /> by Lessee and situated on the Leased Premises. <br /> 8. Hold Harmless. The Lessee hereby agrees to defend, indemnify and hold the <br /> Lessor, their employees and agents, harmless from any and all liability for injuries to persons or <br /> damage to property including any wrongful act or omission arising out of the use of the Leased <br /> Premises. <br /> 9. Assignment and Sublease. Lessee will not sell, assign, sublease or relinquish all <br /> or any part of the Leased Premises hereby leased to them under penalty of forfeiture of all of <br /> their rights under this Commercial Lease Agreement without prior written permission from the <br /> Lessor. Any such assignment shall not relieve the Lessee from liability for the compliance with <br /> the provisions of this Commercial Lease Agreement. <br /> 10. Security for the Payment of Rent. The Lessee further covenants and agrees with <br /> the Lessor that all furniture, fixtures and equipment located upon the Leased Premises and <br /> owned by the Lessee, or which may hereafter be placed upon the Leased Premises by the Lessee <br /> or the Lessee's assigns, shall be and they hereby are,made subject to a lien for the purposes of <br /> securing the faithful performance of each and every covenant and agreement of this Commercial <br /> Lease Agreement and the same shall not be removed until all of the terms and conditions of this <br /> Commercial Lease Agreement have been fully and faithfully performed; however, any purchase <br /> money liens incurred in the acquisition of such items shall be a prior lien to the security for the <br /> payment of rent. <br /> 11. Alterations. The Lessee may, only with prior written approval of the Lessor of <br /> the plans and specifications, make such alterations or additions in or to the Leased Premises <br /> during the term of this Commercial Lease Agreement as are necessary for the Lessee's <br /> occupancy,provided,however, such changes and alterations shall be at the expense of the Lessee <br /> 2 <br />
