COMMERCIAL LEASE AGREEMENT <br /> THIS COMMERCIAL LEASE AGREEMENT is made and entered into on this /7day <br /> of �y , 2018 and effective as of August 1,2018, by and between Roswitha P. <br /> W. c ,Michael L. Wieck, Michael F. Wieck, Mark J. Wieck, and Brian L. Wieck collectively as <br /> Partners in Fonner View Golf, collectively hereinafter referred to as the"Lessor", and Michael F. <br /> Wieck, as an individual,hereinafter referred to as the"Lessee". <br /> WITNESSETH: <br /> 1. Description of Leased Premises. The Lessor does hereby demise, let and lease <br /> unto the Lessee the following described property,hereinafter referred to as the"Leased <br /> Premises": A single building located at 2224 S. Stuhr Road, Grand Island, Nebraska 68801, <br /> more specifically shown on Exhibit"A", which is incorporated herein by this reference. <br /> 2. Term. This Commercial Lease Agreement is for a term of one(1)year <br /> commencing on August 1, 2018 and ending on July 31,2019 unless earlier terminated in <br /> accordance with the terms of this Commercial Lease Agreement. This Commercial Lease <br /> Agreement shall be renewable only upon written agreement of Lessor and Lessee. <br /> 3. Consideration. The Lessee covenants and agrees to pay to the Lessor at 5766 W. <br /> Stolley Park Road, Alda,Nebraska 68810 or wherever the Lessee may be directed in writing,the <br /> sum of One Hundred and NO/100 Dollars($100.00) in twelve (12) consecutive monthly <br /> installments. The first month's rent shall be due and payable on August 1, 2018 in the amount of <br /> One Hundred and NO/100 Dollars ($100.00). Subsequent rental payments shall be due and <br /> payable on the first of each month thereafter during the term of this Commercial Lease <br /> Agreement in the amount of One Hundred and NO/100 Dollars ($100.00). <br /> 4. Use of the Premises. The Leased Premises is to be used by the Lessee for the <br /> purposes of owning and operating a concessions business at Fonner View Golf Course. <br /> 5. Utilities. The Lessee shall, at the Lessee's own expense, furnish all utilities used <br /> by the Lessee on the Leased Premises and shall not permit water charges, electricity charges, or <br /> sewer charges to become a lien against the Leased Premises, it being specifically understood and <br /> agreed that the use of water, electricity and other utilities on the Leased Premises shall be at the <br /> risk of the Lessee. <br /> 6. Maintenance by the Lessee. Lessee agrees to accept the Leased Premises on an <br /> "as is"basis and, the Lessee, at the Lessee's own expense, shall maintain and keep in repair all <br /> exterior doors and replace all glass in the Leased Premises and, in addition thereto, keep in repair <br /> the entire interior of the Leased Premises including, but not limited to,the electrical system and <br /> plumbing. However, in the event that the heating, ventilating and air conditioning systems must <br /> be repaired or replaced,the Lessee shall pay for all minor repairs(repairs less than$100.00 per <br /> occurrence) to said heating, ventilating and air conditioning systems and the Lessor shall pay for <br /> all major repairs (repairs in excess of$100.00 per occurrence) and all replacements necessary to <br /> keep said heating, ventilating and air conditioning systems in proper working order during the <br /> 1 <br />
