and shall not injure or basically affect the structural parts of the building, all work to be done in a
<br /> first-class workmanlike manner and comply with all laws, rules and regulations of the State of
<br /> Nebraska and the County of Hall covering such matters. It is further agreed that the Lessee,when
<br /> taking possession of the property, may install in the Leased Premises such furniture, equipment,
<br /> shelving and attachments as may be deemed necessary, suitable or desirable for the conduct of
<br /> Lessee's business,and the same,including such as may be temporarily attached to the building,
<br /> may be removed; the Lessee,however, shall pay for the repair of any damage to the building
<br /> occasioned by such removal. However, any alterations,changes or additions to the building,the
<br /> heating, air-conditioning or ventilating systems or the plumbing or wiring made by the Lessee
<br /> becomes and remains the property of the Lessor.
<br /> 12. Ouiet Enjoyment. The Lessee, upon paying the rents and performing the
<br /> covenants of this Commercial Lease Agreement on the Lessee's part to be performed, shall
<br /> quietly occupy and enjoy, during said term,the Leased Premises without any hindrance or
<br /> molestation by or on the part of the Lessor.
<br /> 13. Defaults. It is understood and agreed that any failure of the Lessor or the Lessee
<br /> to enforce rights or seek remedies upon any default of the other party, with respect to the
<br /> obligations of each other or either hereunder, shall not prejudice or affect the rights or remedies
<br /> of each or either of them, in the event of any subsequent default. In the event that any payment
<br /> of rent or any charges herein included as rent shall at any time be in arrears and unpaid and shall
<br /> remain unpaid for five (5) days, the Lessor, at Lessor's option, may declare the Lessee in default
<br /> without further notice and proceed as hereinafter set forth. In the event Lessee shall fail to
<br /> comply with any other conditions of this Commercial Lease Agreement, or shall not well and
<br /> truly perform and fulfill each and every covenant and agreement herein contained on the part of
<br /> the Lessee to be performed and kept, and said default shall continue for five (5) days, the Lessor
<br /> shall notify the Lessee in writing of such default and in the event that such default is not
<br /> corrected within ten (10) days, the Lessor may, at Lessor's option, declare the Lessee in default
<br /> and proceed as hereinafter set forth. In the event that Lessee shall make an assignment for the
<br /> benefit of creditors, and said assignment shall not be revoked or set aside within ten (10) days
<br /> thereafter, or said Lessee shall abandon or vacate said Leased Premises during the term hereof,
<br /> or if the interest of the Lessee in said Leased Premises shall be sold under execution or other
<br /> legal process, the Lessor may, at Lessor's option, proceed as hereinafter set forth. In the event
<br /> that any of the foregoing defaults shall take place, the Lessor may enter in and upon said Leased
<br /> Premises and again have, repossess and enjoy the same as if this Commercial Lease Agreement
<br /> had not been made, and thereupon this Commercial Lease Agreement and everything herein
<br /> contained on the part of the said Lessor to be kept and performed, shall cease and be utterly void,
<br /> without prejudice,however, to the right of the Lessor to recover from the said Lessee, its assigns
<br /> or guarantors, all rent due for the term of this Commercial Lease Agreement and to resort to any
<br /> other legal remedies available to the Lessor on account of the default of the Lessee. It is
<br /> specifically understood by the Lessee that the Lessor shall have no duty to mitigate damages but
<br /> in the event that the Lessor should rent the Leased Premises to others, the Lessor shall give the
<br /> Lessee credit for such rent received after all actual damages resulting to the Lessor, including,
<br /> but not limited to, making the Leased Premises ready for the new lessee, have been deducted
<br /> therefrom.
