permitted, authorized or allowed by the previous zoning regulation prior to the adoption of an amendment to <br /> that zoning regulation. <br /> 2.03.172EXPRESSWAY shall mean a street or road that provides fast and efficient movement of large volumes of <br /> vehicular traffic between areas and does not provide direct access to property. <br /> 2.03.173 EXTRATERRITORIAL JURISDICTION shall mean the area beyond the corporate limits, in which a city <br /> or village has been granted the powers by the state to exercise zoning and building regulations and is <br /> exercising such powers. <br /> Section 2.03H <br /> 2.03.200HALF-STORY shall mean a story under a gable,hip or gambrel roof,plates of which are not more than three <br /> (3)feet above the floor of such story. <br /> 2.03.201 HALFWAY HOUSE shall mean a licensed home for individuals on release from more restrictive custodial <br /> confinement or initially placed in lieu of such more restrictive custodial confinement, living together as a <br /> single housekeeping unit, wherein supervision, rehabilitation and counseling are provided to mainstream <br /> residents back into society, enabling them to live independently. <br /> 2.03.202HAZARDOUS WASTE shall mean waste products of industrial or chemical process including finished <br /> surplus, used, contaminated or unwanted fertilizer, herbicide, petroleum products, or other such processed <br /> waste material. <br /> 2.03.203HEALTH CARE FACILITIES shall mean a facility licensed or approved by the state or an appropriate <br /> agency, if required,used in any of the following: <br /> 1. Hospitals including offices or medical societies, offices of charitable public health associations, and <br /> private office space for the practice of medicine and dentistry under a license from the Department of <br /> Health of the State of Nebraska; provided, that any such private offices for the practice of medicine <br /> and dentistry shall be occupied only by those on the staff of the hospital; <br /> 2. Convalescent or nursing home; <br /> 3. A facility for outpatient physical, occupational, or vocational therapy or rehabilitation; <br /> 4. Public health clinics and facilities; and <br /> 5. Ambulatory surgical care center which does not allow for overnight stay by patients. <br /> Except as herein provided, health care facilities do not include doctors, or dentists professional offices and <br /> private clinics. <br /> 2.03.204HEALTH CLUB shall mean privately owned for profit facilities such as gymnasiums, athletic clubs, health <br /> clubs,recreational clubs,reducing salons, and weight control establishments. <br /> 2.03.205 HEALTH RECREATION FACILITY shall mean an indoor or outdoor facility including uses such as game <br /> courts, exercise equipment, locker rooms,whirlpool spa and/or sauna and pro shop. <br /> 2.03.206HEIGHT OF BUILDING shall mean the vertical distance above grade to the highest point of the coping of a <br /> flat roof, of the peak of a gable roof, or of any other type of pitched, hipped, or mansard roof. The grade may <br /> mean the highest adjoining sidewalk or ground surface within a five(5)foot horizontal distance of the exterior <br /> wall of the building, when such sidewalk or ground surface is not more than 10 feet above grade. The height <br /> of a stepped or terraced building is the maximum height of any segment of the building. <br /> 2.03.207HIGHWAY, MAJOR INTER-REGIONAL shall mean a "U.S." or "State" designated highway with 100 <br /> feet right-of-way or more on which partial control of access and geometric design and traffic control measures <br /> are used to expedite the safe movement of through vehicular traffic. <br /> 2.03.208HIGHWAY SETBACK LINE shall mean the future right-of-way line or plan lines of any highway. A yard <br /> abutting such a highway shall be measured from this future right-of-way line. <br /> 2.03.209HISTORIC SITE shall mean one (1)or more parcels, structures, or buildings that is either: Included on a city <br /> listing of historic properties covered by the city's historic property overlay zoning district, included on the <br /> state register of historic properties, designated on the National Register of Historic Places, or authenticated as <br /> historic in a survey and report by a registered architect or an architectural historian and the report accepted by <br /> the City.
