Lanfear questioned if he would recommend the same stipulations as the first subdivision with no <br /> net fill. <br /> Mr. Nabity stated that this part does not have the floodway. They are required to get a <br /> development permit but people do not always do that. They are to have a permit even if they <br /> put gravel on the drive way or build a fence. They are supposed to get the permits. The logic is <br /> there but the practicality is not. <br /> Bredthauer expressed concern regarding policing the property if it is sold in the future. There <br /> are not any other subdivisions that have the net zero fill. She is concerned that it will cause <br /> problems in the future. <br /> Bredthauer made a motion and Lancaster seconded to strike the net zero fill. This is still the <br /> public hearing so they cannot make a motion now. The motion was cancelled. <br /> Lancaster expressed concern that it could cause problems. <br /> Mr. Nabity stated that they have model flood plain regulations from the state and the state gets <br /> these regulations from FEMA. If they do not follow the regulations they would not be in <br /> compliance and people would have to pay cash for a home because they would not be able to <br /> get a loan. <br /> Lancaster stated the county is fortunate to have someone to explain this and we need to use the <br /> plan that causes the least concern this is a good thing for the future. <br /> Richardson stated that the zero net fill was to eliminate building to high or adding too much <br /> gravel. The one side as a floodway but the other one does not. <br /> Quandt questioned what the city does regarding this and Mr. Nabity stated that there are no <br /> floodway's in the city. They do not do zero net fill. The county board could change this. <br /> Bredthauer noted that the board could do it directly but the property owners would have to agree <br /> and they could change the subdivision agreement. It would be easier to have it in the <br /> subdivision agreement. <br /> Chair Richardson called for public participation. <br /> Kim and Dave Bockman requested to address the county board. She noted that they <br /> purchased this home 25 years ago and were the only house there. But their lives have been <br /> changed and she would like to address some issues. She noted concerns on the following. <br /> • There is trash from the construction site <br /> • Flood lights shine on their house <br /> • There is loud noise <br /> • Large construction equipment <br /> • They have brought in 30 loads of dirt and who is monitoring this <br /> 4 <br />
