RESOLUTION#18- (C) I t A RESOLUTION PERMITTING THE CONDITIONAL USE OF THE NORTHEAST QUARTER OF THE NORTHEAST QUARTER OF SECTION TWENTY-THREE(23),TOWNSHIP TEN(10)NORTH, RANGE TWELVE (12)WEST OF THE 6TH P.M.,HALL COUNTY,NEBRASKA. WHEREAS, Cooperative Producers, Inc., a Nebraska corporation, hereinafter referred to as permittee, is the owner of a tract of land to-wit: The Northeast Quarter of the Northeast Quarter(NE 1/4 NE 1/4) of Section Twenty-Three (23), Township Ten (10) North, Range Twelve (12) West of the 6th P.M.,Hall County,Nebraska; and WHEREAS,permittee has applied for a permit to use the above-described property for operation of an anhydrous ammonia fertilizer facility, for petroleum storage and accessory uses and for sales of tires and agricultural supplies; and WHEREAS, the above-described property is located in AG-1 and AG-2 Zoning District; and WHEREAS, anhydrous ammonia fertilizer facilities, petroleum storage facilities and accessory uses and sales of tires and agricultural supplies are permitted conditional uses within the AG-1 and AG-2 Zoning Districts; and WHEREAS,the Hall County Board of Supervisors held a public hearing at its regular meeting on April 3,2018,on permittee's application following published notice of said public hearing; and WHEREAS, the County Board of Hall County, Nebraska has the authority under the County Y Y Zoning Resolution to permit the use of real property within the AG-1 and AG-2 Zoning Districts for anhydrous ammonia fertilizer facilities and similar toxic storage accessory uses, as well as sales of tires and agricultural supplies, subject to such conditions as determined proper by the County Board of Hall County,Nebraska. NOW,THEREFORE,BE IT RESOLVED AS FOLLOWS: I.That permittee's application for a conditional use permit to use the above-described lands for an anhydrous ammonia fertilizer facility, and for petroleum storage and accessory uses and for sales of tires and agricultural supplies is hereby granted subject to the conditions, limitations, and restrictions set forth herein. II. That this Conditional Use Permit,with reference to the above-described lands,is approved and granted upon the following conditions: 1. That any accessory use of the premises shall be a use of a nature customarily incidental and subordinate to the principal uses of an anhydrous ammonia fertilizer facility, and of a petroleum storage facility and sales of tires and agricultural supplies. 2. That all means of ingress and egress to the property shall be approved by the county zoning director, who shall consider automotive safety and convenience, traffic flow and control,and access in case of fire or other emergency.
