3. That all structures, buildings, service drives and parking and storage areas shall be <br /> constructed and installed in accordance with the county zoning codes and subject to the <br /> approval of the state electrical inspector. <br /> 4. Off-street parking shall be provided at the rate of 1 space per 200 square feet of gross <br /> floor area. <br /> 5. Areas used for the storage of anhydrous ammonia, petroleum products and similar <br /> toxic substance, fertilizer application equipment and tires shall be enclosed within <br /> buildings or, if stored outdoors, shall be enclosed by chain link or other fence designed, <br /> constructed, and installed in such a manner as to prevent the unauthorized entry of <br /> persons into said storage areas during non-business hours. <br /> 6. Storage and handling of anhydrous ammonia fertilizer, petroleum products and similar <br /> toxic substances shall comply with the general industry standards for such activities or as <br /> required by local, state and federal laws and regulatory agency rules and regulations. In <br /> case of a conflict in such standards, laws, rules and regulations, those standards, laws, <br /> rules and regulations which provide the greater protection to safeguarding the interests of <br /> adjoining property owners and the general public shall apply. <br /> 7. The uses authorized by this resolution shall be subject to any limitations, conditions, <br /> and restrictions set forth in the County Zoning Resolution which are not inconsistent with <br /> provisions set forth herein. <br /> 8. The above-described real estate must, at all times, be kept in a clean, neat and orderly <br /> condition. <br /> 9. No substances shall be placed or stored upon the real estate in such a way as to create <br /> an unreasonable hazard or nuisance to adjacent,landowners or to the general public. <br /> 10. No uses under this Conditional Use Permit shall result in air, water or groundwater <br /> pollution which creates an unreasonable hazard or nuisance to the adjacent landowners or <br /> to the general public. <br /> 11. The term of this Conditional Use Permit shall be for a period of five (5) years <br /> beginning the date hereof, but may be terminated if permittee fails to comply with any of <br /> the conditions, restrictions and obligations set forth herein. The Hall County Board of <br /> Supervisors shall notify the permittee in writing setting forth the specific area of <br /> noncompliance. If the permittee fails to take reasonable action to comply with the notice <br /> of noncompliance and correct any or all violations within 30 days after receiving said <br /> notice, the Hall County Board of Supervisors shall hold a hearing to consider the <br /> revocation and termination of the Conditional Use Permit by a majority vote. <br /> 12. Nothing in this grant of Conditional Use shall be construed as a grant of right, <br /> authority or permit to allow any use of land, materials or methods which violate any state <br /> or federal law or rule or regulation of a federal, state or local agency other than as <br /> specifically set forth herein. The permittee shall be required, as a condition of this <br /> permit,to comply with all applicable state and federal laws and regulations including, but <br /> not limited to, those pertaining to water quality, flood control and protection, and <br /> environmental quality and protection. <br />
