This is the <br /> resolution for the condition use permit and he does not see any reason to not move forward. <br /> Schuppan made a motion and Richardson seconded to approve Resolution#17-032 for the <br /> conditional use permit for O'Neill Wood Resources LLC for the operation of a construction and <br /> demolition waste disposal area. <br /> Bredthauer made a motion to wait two weeks and to add more in the resolution regarding future <br /> complaints and have a committee go out and do inspections and take pictures. Then if there are <br /> complaints the committee would have proof of the inspections. Discussion was held and the <br /> motion would have to be amended. <br /> Richardson noted that the Regional Planning Commission passed the conditional use and there <br /> are letters from DEQ. <br /> Arnold noted that there is no one here to present a reason to deny and if it is denied there <br /> needs to be a reason. Pictures could be helpful in court but the pictures have to be dated and <br /> the defendant would be able to present their side of the issues. He asked Mr. O'Neill if he <br /> would like to respond about the allegations and he did not. If there were violations the board <br /> could dissolve the conditional use permit and they would not be able to operate. If that would <br /> happen there is a bond to close the site. <br /> Lanfear noted that he received phone calls that it was not in the best interest in Grand Island <br /> because it was privately owned. He questioned why this did not come up 2 weeks ago. <br /> Bredthauer just wants to take another look and make sure we are on top of the issues and if it <br /> goes back to the committee at least it was discussed. <br /> Arnold expressed concern on the lateness of the information in any other proceeding it would <br /> not be allowed. It was not presented at the hearing and it was too late for Mr. O'Neill to present <br /> his rebuttal. If it comes to the county board it is communications. <br /> Discussion was held regarding completion with a municipal land fill. There is a reason for and C <br /> & D land fill so it does not fill up the municipal land fill no different that tires. <br /> Schuppan state that if the permit is denied after two public hearings and there are zero negative <br /> objections why this information was not presented at the public hearings. <br /> Richardson also noted that there was zero opposition to the site at the public hearings. <br /> Regional Planning Director Chad Nabity stated that this is a good use for the land and it is a <br /> place where we know we will not have residential competition. This is industrial and ag land use <br /> and you would not want to have residential in the area with the remanufacture of rail cars or the <br /> demolition of explosives devices you would want these businesses as far away from people as <br /> possible. It is a good location for construction and demolition debris is not municipal waste <br /> and C & D debris in a municipal land fill would make it hard to locate. It is in an area that will <br /> have minimal conflict. <br /> Bredthauer suggested to not approving the resolution and to table it and write the resolution so <br /> that if there is a complaint it would be covered. She suggested a committee or have a third <br /> party inspection and the county could send whoever it wanted. Discussion was held. <br /> 3 <br />
