Arnold noted that the conditional use permit is to make sure that the use fits the zoning <br /> regulations. It does not require the county to enforce state laws that is left up to the state. If <br /> they are not following the state laws it can be inspected for violations. He also noted that there <br /> should be people to do these inspections that are trained. If they do not follow the rules then <br /> they cannot operate. <br /> Mr. Zitterkopf noted paragraph #5 they provide access discussion was held. <br /> Mr. Zitterkopf stated that he feels the language is more than efficient the County Board would <br /> designate who goes out there. He read paragraphs 4, 5 and 6 and stated he is at a loss of what <br /> else that would need to be done. <br /> Arnold noted that adding more could cause more exposure to the county and we may not have <br /> the authority to put in any more requirements. Mr. Zitterkopf stated that he does not think that is <br /> true because this is a permitted use and the county is permitted to add conditions. <br /> Schuppan stated he has read the agreement and feel s that the concerns are already answered. <br /> Lancaster stated that she has serious reservations because she lived through the water issues <br /> at Capital Heights. She would like to add the word "and" if there are no objections. She read the <br /> sentences that could have the word and added. <br /> Schuppan amended his motion and Jan seconded to add the word "and" to the conditional use <br /> resolution as stated. <br /> Chairman Lancaster ask Mr. O'Neill if he wanted to respond and he stated no. <br /> The vote on the motion was taken to approve Resolution# 17-032 for the conditional use permit <br /> for O'Neill Wood Resources. Arnold, Lancaster, Lanfear, Richardson and Schuppan all voted <br /> yes and Bredthauer and Quandt voted no. Motion carried. <br /> 4 <br />
