C DISCUSSION AND POSSIBLE APPROVAL OF SETTLEMENT WITH DEB REA—Mr. <br /> Zitterkopf stated that during the executive session the board was given an opportunity to view <br /> and discuss the settlement agreement and for the record this agreement is among and between <br /> Deb Rea, Jimmy Vann, Fred Ruiz and Hall County Nebraska. It resolves the claims among <br /> those 4 parties. That agreement becomes effective with all of the signatures and resolves all <br /> claims and all claims from any past occurrences. The agreement contains a non-admission <br /> clause as follows " <br /> This agreement will not in any way be construed as an admission by the County, Ruiz or Vann <br /> of any wrongful or unlawful act or omission against Rea or any other person. The County, Ruiz <br /> and Van Specifically disclaim any liability to or wrongful or unlawful act or omission against, Rea <br /> or any other person." The following funds of$4,877.46 less applicable federal and state <br /> withholding payable to Deb Rea, $45,000.00 payable to Deb Rea, $25,112,54 payable to <br /> Powers Law Firm. <br /> Richardson made a motion and Lancaster seconded to approve the settlement agreement. <br /> Arnold, Lancaster, Lanfear, Purdy, Quandt and Richardson all voted yes and none voted no. <br /> Schuppan was absent. Motion carried. <br /> Mr. Zitterkopf has 3 copies of the agreement for signatures. The past wages of$4877.46 will be <br /> paid to Ms. Rea and he will give direction to the Clerk regarding the wages. <br /> BID OPENING FOR GRAVEL 10:50 A.M. —Quandt made a motion and Lanfear seconded to <br /> open the bid for the annual gravel letting. Arnold, Lancaster, Lanfear, Purdy, Quandt and <br /> Richardson all voted yes and none voted no. Schuppan was absent. Motion carried. <br /> County Surveyor Casey Sherlock stated that they budgeted $300,000.00 for the gravel and <br /> $275,000.00 was the final budget approval his current remaining budget is $244,000.00.
