Arnold stated the board needs to stand behind the enforcement of Hall County Resolutions and <br /> if we do not agree with the zoning we move forward and then address the regulations. It is the <br /> responsibility of the owner to have a permit. <br /> Schuppan stated we cannot change the rules now but once this is over then look at the <br /> regulations. <br /> Paul Wicht asked to address the board. He ask if the board had talked to Mr. Kohlhof and <br /> Schuppan and Lancaster indicated they had. He stated his numbers are down and he <br /> addressed the location of the house. You cannot eliminate the smell of a feed lot. He <br /> questioned if there is a permit from DEQ and if the county can supersede those rules. He <br /> stressed that you cannot make money with a 1000 head of cattle. He also stated that Mr. <br /> Kohlhof was told they were going to rewrite the laws when he asks for a conditional use permit. <br /> He also expressed concern on the chicken hatchery. He stated the board should give him some <br /> time. <br /> Arnold noted that it has been months and the board has heard nothing from the owner. He <br /> thanked Mr. Wicht for speaking. <br /> Lancaster stated we take an oath to uphold the law and if there is something that needs to be <br /> addressed regarding the regulations nothing has come to the board that would suggest that the <br /> county should do this. She noted that the county can make rules that are more restrictive than <br /> the state. <br /> Schuppan stated that he has been involved since the beginning under the current regulations <br /> they cannot make this work there was discussion to have Chad Nabity form a committee to take <br /> a look at these regulations. We cannot change the rules to make him legal but could have <br /> regional planning form a committee to look at this he would also like to know what other <br /> counties do. <br /> Mr. Zitterkopf stated he wanted to address Mr. Wick's comments. We should not make changes <br /> for one case. He talked to Chad about a variance and but this does not fall under a variance <br /> request and also the issue about the neighbors to the east and who was there first or not this <br /> issue would be addressed in a lawsuit. Maybe the numbers are down, but it is still over a <br /> thousand. <br /> Schuppan stated they may need to look at the regulations but this is not what we are talking <br /> about today. He is not sure how to proceed. <br /> Quandt questioned where C & I are at with the Nebraska Department of Environmental Quality <br /> and Jack stated that he is not sure that there is even a pending application with DEQ. <br /> Richardson stated that there are a number of wonderful cattle feeding operations and they <br /> follow the restrictions but we may need to look at the regulations. Richardson stated she <br /> appreciates the cattle produces in the area. <br /> The vote on the motion to authorize Jack to proceed with the injunction was taken. Arnold, <br /> Lancaster, Lanfear, Purdy, Quandt, Richardson and Schuppan all voted yes and none voted no. <br /> Motion carried. <br /> 4 <br />
