9:05 a.m. Held a Board of Equalization meeting <br /> 9:12 a.m. Adjourned the Board of Equalization meeting and returned to the regular meeting. <br /> PUBLIC PARTICIPATION —Chairman Arnold called for public participation and Paul Wicht <br /> requested to address the feed lot issue. <br /> COUNTY ATTORNEY - UPDATE & POSSIBLE ACTION REGARDING C & I CATTLE <br /> COMPANY, INC. County Attorney Jack Zitterkopf stated that the case with C&I Cattle Company <br /> started in late October. He is not in compliance with the zoning regulations and Mr. Kohlhof has <br /> legal counsel to represent him. Jack stated he talked to Mr. Kohlhof' s attorney and the only <br /> change since October is that Mr. Kohlhof is trying to divest his interest in C & I Cattle Company <br /> but there are still 3000 head of cattle on this lot with no conditional use permit. Any lot with over <br /> 1000 head of cattle requires a conditional use permit. There have also been comments that the <br /> county attorney has no control over a feed lot but when he took his oath of office it was to <br /> uphold all the regulations of Hall County and he does not pick and choose what he will uphold. <br /> He has not taken any action and was going to request an injunctive proceeding against C & I <br /> Cattle Company. Today he is asking for a motion from the county board to proceed with the <br /> injunction. <br /> Lancaster asks if he is trying to divest himself of ownership if that changes anything and Mr. <br /> Zitterkopf stated that it does not. <br /> Jack stated that he has been accused of trying to cause trouble and he would like the support of <br /> the county board. <br /> Lancaster stated it is our obligation to uphold the laws we also take an oath of office. <br /> Quandt asked what type of action does the board need to do? He also stated it is our job to <br /> uphold the laws. <br /> Jack stated it is not his intention to seek an immediate or irreparable injury to the party he would <br /> just file the injunction and let the lawsuit take its course. He needs a motion to proceed with an <br /> injunctive process. <br /> Schuppan noted that there was discussion that the planning commission would take a look at <br /> the regulations but that has not been done. <br /> Jack stated he agrees maybe they could look at relaxing the rules but that is not in place now <br /> and there isn't an application for a conditional use permit and Mr. Kohlhof is not trying to get in <br /> compliance. He is not sure about the status with the DEQ and even if they did get a permit from <br /> DEQ they still have to be in compliance with the Hall County rules. <br /> Lanfear stated we are all responsible and Jack should have the support. Lanfear made a <br /> motion and Schuppan seconded to authorize County Attorney Jack Zitterkopf to proceed with <br /> the injunctive process. <br /> Richardson stated we do not have a choice they have been given warnings and nothing has <br /> been done. <br /> 3 <br />
