Schuppan made a motion and Richardson seconded to go into executive session. This <br /> executive session is to protect the public interest. Arnold, Lancaster, Lanfear, Purdy, Quandt, <br /> Richardson and Schuppan all voted yes and none voted no. Motion carried. <br /> 11:17 a.m. executive session <br /> 11:39 a.m. Schuppan made a motion and Richardson seconded to go out of executive session. <br /> Arnold stated that no other subjects were discussed, no votes were taken and no action was <br /> taken. Arnold, Lancaster, Lanfear, Purdy, Quandt, Richardson and Schuppan all voted yes and <br /> none voted no. Motion carried. <br /> Mr. Sherlock stated that the purchase of the real estate was not the subject of the executive <br /> session. They have entered into a purchase agreement and he has talked to the attorney with <br /> Southern Public Power. They are working on the deed and easement language. The deed will <br /> be lengthy and there are environmental protection issues that are not usually on any other <br /> properties. He is aware of those restrictions and they will proceed. <br /> Quandt asked if there can be wells and Casey responded that there are some restrictions on <br /> drinking water wells. He stated that there is a well on the property owned by O'Neil's and there <br /> is a pipe that runs underground but they will put down their own well. He also stated that Jack <br /> has ordered the title insurance. <br /> 11 .RECEIVE & PLACE ON FILE PETITION REGARDING REQUEST TO CHANGE ZONING <br /> REGULATIONS-- Mr. Purdy stated that he talked to Chad Nabity before the meeting and the <br /> board can receive and place this on file and make a recommendation that they make application <br /> to the regional planning commission. Chad Nabity was present and he stated that there is a <br /> process that they can request to amend the zoning regulations. There is a fee that they have to <br /> pay and statutory requirements that are followed. There is an application form that they <br /> complete. This would go to the Regional Planning Commission and they would hold a public <br /> hearing and the make a recommendation the county board and then the board would hold a <br /> public hearing and decide whether to accept or not accept the change. That is the process that <br /> is in place. <br /> Quandt made a motion to receive and place on file the petition and refer it to regional planning. <br /> Motion failed no seconded was received. <br /> If the board refers it to regional planning then they would move forward as a recommendation <br /> from the county board. If the Petitioner makes the request then they would pay the fee then <br /> regional planning would hold a public hearing. <br /> Chad stated that there are already permitted zoning districts where they can have a truck wash. <br /> This is a A-1; A 2 and A 3 zones require a conditional use permit. The petitions request is to <br /> exclude the A 3 zone, it would not be allowed as a conditional use. Discussion was held and <br /> they can make application to the planning commission and pay the fee. <br /> Richardson made a motion and Lanfear seconded to receive and place on file the petition. <br /> Quandt the difference is that they have to pay a fee. <br /> Lancaster noted that if we accept and place on file then see what happens if we perform a <br /> service why they shouldn't cover some of the costs. They can help offset the cost of doing <br /> 5 <br />
