RESOLUTION#16- D ,4 <br /> A RESOLUTION GRANTING A CONDITIONAL USE PERMIT FOR THE USE <br /> OF A TRACT OF LAND SITUATED IN THE SOUTHEAST QUARTER(SE 1/4) <br /> OF SECTION TWENTY-TWO(22),TOWNSHIP TEN(10) NORTH, <br /> RANGE NINE(9)WEST OF THE 6TH P.M.,HALL COUNTY,NEBRASKA; APPLICATION <br /> OF USCOC NEBRASKA./KANSAS LLC AND DUANE RIEFLIN <br /> AND VADA RIEFLIN, HUSBAND AND WIFE <br /> WHEREAS, USCOC Nebraska/Kansas LLC and Duane Rieflin and Vada Rieflin, husband <br /> and wife, herein jointly and severally referred to as the "Applicant," have made application for a <br /> Conditional Use Permit pursuant to the hall County Zoning Resolution for the conditional use of the <br /> following described property for the operation and maintenance of a 280 foot self-supporting lattice <br /> communications tower and an associated equipment shelter all upon the following described property, <br /> to-wit: <br /> A tract of land situated in the Southeast Quarter(SE 1/4)of Section Twenty-Two(22), <br /> Township Ten (10) North, Range Nine (9) West of the 6th P.M., Hall County, <br /> Nebraska, more particularly described as follows: Commencing at a point on the <br /> South line of the Southeast Quarter of said Section 22, 410 feet West of the Southeast <br /> corner of said Southeast Quarter; thence proceeding West along and upon said South <br /> line of the Southeast Quarter a distance of 510 feet; thence North on a line parallel to <br /> the East line of the Southeast Quarter a distance of 700 feet;thence proceeding East on <br /> a line parallel to the South line of said Southeast Quarter a distance of 510 feet;thence <br /> proceeding South on a line parallel to the East line of the said Southeast Quarter a <br /> distance of 700 feet;thence proceeding West along and upon the South line of the said <br /> Southeast Quarter a distance of 410 feet to the point of beginning, containing 8 acres <br /> more or less; and <br /> WHEREAS, a public hearing regarding said renewal application was held by the County <br /> Board of Supervisors of Hall County, Nebraska on March 22, 2016, after due and proper notice of <br /> same being afforded the public;and <br /> WHEREAS,the said property is located within the AG-1 Agricultural Zoning District;and <br /> WHEREAS,the Hall County Board of Supervisors is empowered under the Zoning Resolution <br /> to grant a Conditional Use Permit for the conditional use of property for development of a tower within <br /> the AG-1 Agricultural district. • <br /> NOW BE IT RESOLVED that the renewal application for Conditional Use Permit for the <br /> conditional use of the above—described property for the above-stated uses be and is hereby approved <br /> subject to the following conditions: <br /> I. Maintenance. The premises shall at all times be maintained in a neat and orderly <br /> condition. The towers,antenna support structures,telecommunications facilities and antennas shall at <br /> all times be kept and maintained in good condition,order and repair so that the same does not constitute <br /> a nuisance to or a danger to the life or property of any person or the public. <br /> 2. Noxious Weeds. Noxious weeds on the premises shall be controlled pursuant to state and <br /> local laws and regulations. <br />
