3. FAA and FCC Compliance. Applicant shall comply with all applicable rules and <br /> regulations of the Federal Aviation Administration regarding the construction, height, design and <br /> maintenance of the communication tower placed upon the above-described property and applicable <br /> rules of the Federal Communications Commission regarding the use of the tower and antennas. <br /> 4. Tower Use, Said tower shall be used for communication purposes only. <br /> 5. Conditional Use Standards, Said towers, telecommunications facilities and antennas <br /> shall be developed,designed, constructed,maintained,and operated so as to conform with Applicant's <br /> Renewal Application for Conditional Use, the Hall County Zoning Resolution, the Hall County <br /> Building Codes, applicable federal and state law and regulations, and applicable American National <br /> Standards Institute(ANSI)standards.In the event of a conflict,the Hall County Zoning Resolution,the <br /> Hall County Building Codes, applicable federal and state law and regulations, and applicable <br /> American National Standards Institute (ANSI) standards shall govern and control over Applicant's <br /> renewal application. <br /> 6. Co-location of Antennas. The tower shall be designed and constructed so as to permit <br /> co-location of additional antennas as are technologically and logistically feasible. <br /> 7. Co-location of Emergency Service Antennas, The Applicant shall permit co-location of <br /> County emergency service antennas as provided in the County Zoning Resolution, <br /> 8. Setback. The tower shall meet applicable setbacks as provided in the County Zoning <br /> Resolution and as directed by the County Building Inspector. <br /> 9. Lighting. The tower shall not be artificially lighted unless required by the Federal <br /> Aviation Administration. <br /> 10. Security. The tower shall be enclosed within a security fence or other structure designed <br /> to preclude unauthorized access or shall be designed and constructed in a manner which will preclude <br /> to the extent practical, unauthorized climbing of said structure. <br /> 11. Signs. Except as required by state or federal law or regulations, no signs shall be <br /> allowed on any antenna or tower. <br /> 12. Inspection. The County reserves the right to conduct an inspection of towers, antenna <br /> support structures,telecommunications facilities and antennas upon reasonable notice to the Applicant <br /> or operator to determine compliance with county resolutions and codes and to prevent structural and <br /> equipment failures and accidents which may cause damage, injuries or nuisances to the public. <br /> Inspections may be made to determine compliance with the Hall County Building Codes, the Hall <br /> County Zoning Resolution, federal and state law or regulations, or applicable ANSI standards. <br /> 13. Abandonment. If the tower shall cease to be used for a period of three hundred <br /> sixty-five(365)consecutive days,the Building Department shall notify the Applicant that the site will <br /> be subject to a determination by the Building Department Director that the site has been abandoned. <br /> Upon issuance of a Notice to Show Cause by the Building Department Director, the Applicant shall <br /> have thirty (30) days to show by a preponderance of the evidence that the tower has been in use or <br /> under repair during the period of apparent abandonment. In the event the Applicant fails to show that . <br /> the tower has been in use or under repair during the relevant period, the Building Inspector shall issue <br /> a final determination of abandonment of the site and the Applicant shall have seventy five (75) days <br /> thereafter to dismantle and move the tower. <br />
