RESOLUTION#16- 0 Q 5 <br /> A RESOLUTION GRANTING THE RENEWAL APPLICATION FOR <br /> THE CONDITIONAL USE OF A CERTAIN TRACT OF LAND LOCATED <br /> IN THE SOUTHWEST QUARTER (SW 1/4) OF SECTION EIGHT (8), <br /> TOWNSHIP ELEVEN (11) NORTH,RANGE TEN (10), <br /> WEST OF THE 6TH P.M.,HALL COUNTY,NEBRASKA <br /> WHEREAS, Mid-Nebraska Disposal, Inc., hereinafter referred to as "applicant," is the owner of <br /> property in Hall County,Nebraska described as follows: <br /> • <br /> A tract of land comprising a part of the Southwest Quarter (SW 114) of Section Eight <br /> (8),Township Eleven (11)North, Range Ten (10), West of the 6th P.M., Hall County, <br /> Nebraska, more particularly described as follows; Beginning at the southeast corner of <br /> said Southwest Quarter (SW 1/4); thence running westerly on the south line of said <br /> Southwest Quarter (SW 1/4), on an Assumed Bearing of S 89° 33' 18" W, a distance <br /> of Eight Hundred Thirty One and Forty Seven Hundredths (831.47) feet; thence <br /> running N 00° 02' 44" E, a distance of Fifty One and Fifty Six Hundredths (51.56) <br /> feet, to a point on the northerly right of way line of 13th Street and the ACTUAL <br /> point of beginning; thence running S 88° 58' 25" W, on the northerly right of way line <br /> of 13th Street, a distance of Nine Hundred Thirty and Twenty Six Hundredths <br /> (930.26) feet, to a point on the easterly line of a Thirty (30) foot wide railroad tract <br /> easement; thence running N 00° 07' 35" E on the easterly line of a Thirty (30) foot <br /> wide railroad track easement, a distance of Eighty Eight and Thirteen Hundredths <br /> (88.13) feet, to a point of curvature; thence running northeasterly on the easterly line <br /> of a Thirty ( )30 foot wide Railroad Track Easement and on the arc of a curve to the <br /> right whose radius is Five Hundred Sixty Five and Thirty Two Hundredths (565.32) <br /> feet, the long of which bears N 46° 06' 34" E, a long chord distance of Eight Hundred <br /> One and Ninety Three Hundredths (801.93) feet, (an arc distance of Eight Hundred <br /> Ninety One and Forty Seven Hundredths (891.47) feet; thence running S 89° 57' 29" <br /> E on the southerly line of a Thirty (30) foot wide railroad track easement, a distance <br /> of Three Hundred Fifty Two and Thirty Three Hundredths (352.33) feet; thence <br /> running S 00° 02' 44" W, a distance of Six Hundred Twenty Seven and Six <br /> Hundredths (627.06) feet to the ACTUAL point of beginning; and <br /> WHEREAS, applicant has filed its renewal application to use the above-described property for <br /> operating a yard waste compositing site; and <br /> WHEREAS,on July 20,2010, the Hall County Board of Supervisors granted a conditional use <br /> permit for said purpose on said property in Resolution#10-039; and <br /> WHEREAS, the above-described property is located in a district presently zoned for AG-SI <br /> use; and <br /> WHEREAS, the proposed conditional use in a district zoned AG-SI is a permitted conditional <br /> use pursuant to Appendix A, Zoning Matrix, of the Zoning Resolution of Hall County, <br /> Nebraska, as amended; and <br />
