WHEREAS, the proposed conditional use is consistent with the Cornhusker Army <br /> Ammunition Reuse Plan;and <br /> WHEREAS, on January 26, 2016, a public hearing on said renewal application was held by <br /> the Hall County Board of Supervisors upon due and proper notice of said hearing; and <br /> • <br /> WHEREAS, at said public hearing the public was given the opportunity to speak in favor of <br /> and in opposition to the application for conditional use; and <br /> WHEREAS, the Hall County Board of Supervisors finds that such use is authorized under the <br /> conditional uses within the AG-SI Zoning District; that such use, as limited herein, will not <br /> adversely affect the public interest; and that said Board is empowered under the Zoning <br /> Resolution to permit such conditional use. <br /> NOW, THEREFORE, BE IT RESOLVED that pursuant to the Zoning Resolution of Hall <br /> County, Nebraska, the Hall County Board of Supervisors hereby grants to Mid-Nebraska <br /> Disposal, Inc. a Conditional Use Permit to use the above-described real estate for the purpose <br /> of operating a yard waste composting site, subject to the following conditions and restrictions: <br /> 1. The above-described real estate must, at all times, be kept in a clean, neat and orderly <br /> condition. <br /> 2. No waste other than yard waste shall be placed or stored upon the real estate. Permittee <br /> shall take reasonable measures to prevent third parties from dumping any other waste on the <br /> property. <br /> 3. No uses under this Conditional Use Permit shall result in air, water or groundwater <br /> pollution which creates an unreasonable hazard or nuisance to the adjacent land owners or to <br /> the general public. <br /> 4. Nothing in this grant of a Conditional Use Permit shall be construed as a grant of right or <br /> authority to allow any use of land, materials or methods which violate any state or federal law <br /> or rule or regulation of federal, state or local agency other than as specifically set forth herein. <br /> The perruittee shall comply with all applicable local, state and federal laws and regulations <br /> including, but not limited to, those pertaining to water quality, flood control and protection <br /> and environmental quality and protection. <br /> 5. The rights granted by this permit of conditional use shall not be assignable or transferable, <br /> and shall not run with the land. <br /> 6. The acceptance by permittee of any benefit or right pursuant to this resolution shall <br /> constitute permittee's agreement to be bound by the terms, conditions and restrictions of this <br /> resolution. <br />
