WHEREAS, the proposed conditional use is consistent with the Cornhusker Army Ammunition Reuse Plan;and WHEREAS, on January 26, 2016, a public hearing on said renewal application was held by the Hall County Board of Supervisors upon due and proper notice of said hearing; and • WHEREAS, at said public hearing the public was given the opportunity to speak in favor of and in opposition to the application for conditional use; and WHEREAS, the Hall County Board of Supervisors finds that such use is authorized under the conditional uses within the AG-SI Zoning District; that such use, as limited herein, will not adversely affect the public interest; and that said Board is empowered under the Zoning Resolution to permit such conditional use. NOW, THEREFORE, BE IT RESOLVED that pursuant to the Zoning Resolution of Hall County, Nebraska, the Hall County Board of Supervisors hereby grants to Mid-Nebraska Disposal, Inc. a Conditional Use Permit to use the above-described real estate for the purpose of operating a yard waste composting site, subject to the following conditions and restrictions: 1. The above-described real estate must, at all times, be kept in a clean, neat and orderly condition. 2. No waste other than yard waste shall be placed or stored upon the real estate. Permittee shall take reasonable measures to prevent third parties from dumping any other waste on the property. 3. No uses under this Conditional Use Permit shall result in air, water or groundwater pollution which creates an unreasonable hazard or nuisance to the adjacent land owners or to the general public. 4. Nothing in this grant of a Conditional Use Permit shall be construed as a grant of right or authority to allow any use of land, materials or methods which violate any state or federal law or rule or regulation of federal, state or local agency other than as specifically set forth herein. The perruittee shall comply with all applicable local, state and federal laws and regulations including, but not limited to, those pertaining to water quality, flood control and protection and environmental quality and protection. 5. The rights granted by this permit of conditional use shall not be assignable or transferable, and shall not run with the land. 6. The acceptance by permittee of any benefit or right pursuant to this resolution shall constitute permittee's agreement to be bound by the terms, conditions and restrictions of this resolution.
