Mr. Zitterkopf stated that the Chief Deputy County Attorney, the Deputy County Attorney and he <br /> also thoroughly evaluated this case and have listened to the concerns and tried to explain the <br /> reasons. His Chief Deputy spend 45 minutes trying to explain the problems of this case to the <br /> family and he knows it is hard for them grasp it was negligence but not a crime and the end <br /> result of the investigation and evidence was insufficient to prove beyond a reasonable doubt. <br /> He has had multiple e mails that have accused him of being ignorant and lazy and these are <br /> strong words and they do not know what they are talking about. He too has an ethical obligation <br /> to not convict some one of a crime. It could have been failure to yield but that would not work <br /> either and there was no evidence of impairment. <br /> Mandy and Paul Schlender caused a complaint to be filed with the Attorney General and he <br /> read the letter regarding this. The Attorney General will not interfere with the decision of an <br /> elected official. Mr. Zitterkopf expressed his deepest sympathy to Mandy and Paul and the <br /> family and friends. He has not abused his authority and he considers this matter closed. <br /> Chairman Arnold called for a 5 minute break. <br /> 11:05 a.m. returned to session <br /> Arnold stated that this was difficult and also affected the board emotionally. There were <br /> concerns expressed on how this worked but it is not anything that the County Board would have <br /> any authority to take action on. There was discussion held and some answers to the questions <br /> were addressed. <br /> BID OPENING — Mr. Riehle was present and stated that Jeff designed the bridge and they have <br /> reviewed the bid bond and it is in proper form and checked the numbers on the bid. He <br /> recommends awarding the bid to Midwest Service & Sales. <br /> Schuppan made a motion and Purdy seconded to award the bid to Midwest Service & Sales in <br /> the amount of$157,065.84. Arnold, Lancaster, Lanfear, Purdy, Quandt, Richardson and <br /> Schuppan all voted yes and none voted no. Motion carried. <br /> Ms. Lancaster thanked Mr. Riehle for is assistance on the tax credit application for the <br /> renovations of the court house. <br /> 5B COUNTY ATTORNEY— DISCUSSION AND POSSIBLE ACTION ON THE BUILDING <br /> INSPECTION SERVICES INTERLOCAL AGREEMENT—County Attorney Jack Zitterkopf <br /> stated that he provided a copy of the Interlocal agreement to the board members but they may <br /> not be prepared to take action on it. The Village of Alda has signed the agreement, Cairo is <br /> meeting tonight to discuss the agreement, Doniphan signed the agreement last night and the <br /> City of Wood River has also signed the agreement. The only signatures that are lacking are the <br /> Village of Cairo and the County Board. This was a collaboration of talents, Jerry Janulewicz, <br /> Andy Baach, Denise Meyer and Jim Truell worked long and hard to put it together. Mr. <br /> Zitterkopf asked for questions from the board. <br /> Schuppan expressed concern on the electrical inspections and Mr. Zitterkopf stated that the <br /> entities rely on the state inspector and noted page 2. Schuppan asked if each village would <br /> have a different code or if it was based on the national code. It was noted that each entity <br /> would have a representative on the committee and they could decide the process for the <br /> 6 <br />
