7.10:00 AM — BID OPENING-- 110TH ROAD BRIDGE PROJECT#C40(333) -The following <br /> bids were received. <br /> BIDDER SECTION A SECTION B SECTION C TOTAL BID <br /> Husker Steel NO BID <br /> Midwest Service $76,519.85 $59,088.66 $21,457.331 $157,065.84 <br /> & Sales <br /> Bid Bond enclosed <br /> Mr. Riehle stated that the painting requirements were that the steel has to be primed because <br /> the painting makes the steel life longer. He will review the numbers and come back later in the <br /> meeting with the results and award the bid today. <br /> PUBLIC PARTICIPATION — Craig Caples with NETS addressed the board regarding software <br /> for document scanning for agenda's and meeting packets for paperless meetings. The school <br /> districts use this program. They build their own software and the user has a say in how it works. <br /> He was at the NACO Conference with this information. <br /> Paul Schlender requested to address the county board on behalf of his deceased brother. He <br /> e mailed information to board members regarding the accident and is asking for more help. He <br /> noted that there were errors in the police report and expressed concern on the lady that was <br /> operating the motor vehicle after taking medication. He expressed concern that there was no <br /> citation issued and no charges filed. The family requested a meeting to get answers regarding <br /> the accident. <br /> Mandy Schlender, from Norfolk Nebraska also requested to address the board regarding the <br /> accident. She read a letter regarding her concerns and is asking for answers why the driver of <br /> the other vehicle was not charged. <br /> 5B DISCUSSION OF LETTER FROM MANDY SCHLENDER - County Attorney Jack Zitterkopf <br /> stated that he received a letter from Mandy Schlender and was going to address it in executive <br /> session but changed his mind once this became public and wanted them to hear the county <br /> attorney's side of the story. <br /> He is not un-sympathetic to motorcycle riders because he had been riding for 52 years and has <br /> ridden 74,000 miles. He is aware of cars making turns in front of riders and it is a real problem. <br /> But, not every act is a crime and not every crime can be proven beyond a reasonable doubt and <br /> you have to prove that. She failed to yield the right of way and that was the probable cause of <br /> his death but you also have rule out negligence or speed if it was at or below the speed limit. <br /> They do not know there was no evidence to prove beyond a reasonable doubt. <br /> Mandy also states that the driver was impaired because of the drugs she was taking and asked <br /> why she was not tested. There is no agreement on the quantity of the medication that is <br /> required to establish impairment. With alcohol we all know the legal standard but on <br /> prescription or legal substances there is no determination what impairment is. They do convict <br /> under drugs and there are drug recognition expert police officers that have had years of training <br /> and can do additional testing. Then they can make a determination if they are not fit to drive. <br /> The Nebraska Courts recognize these drug experts and they found that she was not impaired <br /> by drugs and determined that she was capable of operating a vehicle. <br /> 5 <br />
