RESOLUTION#15-n '4 <br /> A RESOLUTION AUTHORIZING THE CONDITIONAL USE OF <br /> IN A PORTION OF SECTION 36, TOWNSHIP 10 NORTH, RANGE 11 <br /> WEST OF THE 6TH PRIME MERIDIAN, HALL COUNTY, NEBRASKA. <br /> WHEREAS, on or about July 15, 2015, Water's View, Inc. (hereafter, "Applicant") made <br /> an application to the Hall County Board of Supervisors (hereafter, "Board") for the approval of a <br /> conditional use of the following described real estate, to-wit: <br /> Legal Description Attached as Exhibit A(hereafter, "Property") and <br /> WHEREAS, the Property is located within the RC Restricted Commercial and AG-R <br /> Agriculture-River Corridor Zoning Districts of Hall County,Nebraska; and <br /> WHEREAS, the Applicant's application requested a Conditional Use Permit for the <br /> construction and operation of a sand and gravel pit and an asphalt plant, ready-mix plant, and <br /> aggregate recycling plant (hereafter, "Application"); and <br /> WHEREAS, on September 8, 2015, the Board held a public hearing on the Application, <br /> during which the Board heard and considered evidence from the Applicant and others from the <br /> community regarding the Application and whether the Application should be granted or denied; <br /> and <br /> WHEREAS, the Board finds that sand and gravel pits are authorized under the <br /> conditional uses within the RC and AG-R Districts; that a conditional use may be authorized <br /> upon consideration of those factors set forth in Section 11 of the Hall County Zoning Resolution; <br /> that such use, as limited herein, will not adversely affect the public interest; and that the Board is <br /> empowered under the Zoning Resolution to permit such conditional use; and <br /> WHEREAS, having considered the evidence offered by proponents and opponents of the <br /> Application, the Board hereby identifies the following facts in connection with the Applicant's <br /> request to construct and operate a sand and gravel pit at the Property: <br /> 1. The Property has access to roads maintained by the State of Nebraska specifically <br /> Alda Link (L40C) from the south end of the U.S. Interstate 80 ramps north to Alda. <br /> 2. The Property and proposed driveway on the Property have access in close proximity <br /> to U.S. Interstate 80. <br /> 3. The primary tourist season of the neighboring Crane Trust Nature & Visitors Center <br /> and the unique spring migration of wildlife through the area is generally between <br /> February 1 and April 15. <br /> 4. Sand and gravel extraction is one of the few mining and extraction activities available <br />
