<br />~ <br /> <br />~ <br /> <br />r~;:-- ~53 <br />not adversely affect the public interest, and that said Board is empowered under the <br />Zoning Resolution to grant said Conditional Use; and <br />~ WHEREAS, the Board finds that compliance with the specific rules governing <br />individual conditional uses will be satisfied by compliance with the con~tions <br /> <br />contained herein and set forth below. <br />NOW THEREFORE, pursuant to the powers granted under the Zoning <br />Resolution as adopted by the Board of Supervisors of Hall County, Nebraska, the <br />Hall County Board of Supervisors, hereby grants to Platte River By-Products, Ltd. <br /> <br />a Conditional Use Permit to use the above described real estate for the purpose of <br />operating an animal and poultry packing and rendering plant, SUBJECT TO the <br /> <br />following conditions, restrictions and limitations: <br />(A) All liquid and solid waste, rubbish and debris must be completely cleared <br /> <br />from the above described real estate as soon as practical and said real estate must, <br /> <br />at all times, be kept in a clean and neat condition as to be presentable to the general <br /> <br />public. <br />(B) No carcasses of dead animals, offals, spoiled meats, or putrid animal <br /> <br />substances shall be placed or stored upon the real estate in such a way as to create <br /> <br />an unreasonable hazard or nuisance to adjacent landowners or to the general public. <br /> <br />(C) No uses under the Conditional Use Permit shall result in air, water, or <br /> <br />groundwater pollution which creates an unreasonable hazard or nuisance to the <br />adjacent landowners or to the general public. <br /> <br />(D) The term of the Conditional Use Permit shall be for a period of five (5) <br /> <br />years beginning the date hereof, but may be terminated if permittee fails to comply <br />with any of the conditions, restrictions and obligations set forth herein. The Hall <br />County Board of Supervisors shall notify the permittee in writing setting forth the <br /> <br />specific area of noncompliance. If the permittee fails to take reasonable action to <br />comply with the notice of noncompliance and correct any or all violations within <br /> <br />30 days after receiving said notice, the Hall County Board of Supervisors shall hold <br />a hearing to consider the revocation and termination of the Conditional Use Permit <br /> <br />by a majority vote. <br />(E) Nothing in this grant of Conditional Use Permit shall be construed as a <br />grant of right, authority or permit to allow any use of land, materials or methods <br />which violate any state or federal law or rule or regulation of a federal, state or local <br />agency other than as specifically set forth herein. The permittee shall be required, <br />as a condition of this permit to comply with all applicable state and federal laws and <br />regulations including, but not limited to, those pertaining to water quality, flood <br />control and protection, and environmental quality and protection. <br /> <br />(F) . The rights granted by this permit of conditional use shall not be <br /> <br />assignable or transferrable and shall not run with the land. <br />/) This Conditional use Permit is hereby granted this /1 a:- day of <br />
