All pre-existing conditions have been eliminated if some comes on the plan with a pre-existing <br /> condition they will be covered. The last amendment eliminated the life time maximum that has <br /> been stair stepped since 2010. Th i s is also to k eep t h e plan in compl i ance with the federal <br /> regulations. <br /> Purdy made a motion and Schuppan seconded to approve the plan amendments. Arnold, <br /> Lancaster, McFarland, Purdy, Schuppan and Ziola all voted yes and Quandt voted no. Motion <br /> carried. <br /> 5C TITLE VI NONDISCRIMINATION AGREEMENT—Chief Deputy County Attorney Jack <br /> Zitterkopf stated that the county approved the ADA resolution last year. Then the county <br /> received a letter and a compliance questionnaire regarding the Title VI nondiscrimination policy. <br /> He completed that policy by himself last year but called on a group that will be affected by this. <br /> Marla Conley, Steve Riehle, Stacey Ruzicka, Janet O'Malley, Loren Humphrey met as a <br /> committee several times and will continue to meet to address the Limited English Proficiency <br /> policy. The public works receives the largest amount for funding for federal aid bridge or road <br /> projects but to eliminate the issue this will be a county wide policy even if they do not receive <br /> federal funding. Mr. Riehle has been instrumental in moving this forward. <br /> Mr. Riehle stated that because of the federal funding there are requirements from the Title VI <br /> Civil Rights Restoration Act of 1987 that will apply to everything we do and the Limited English <br /> Proficiency policy is also rolled into the Civil Rights Act. There is also the ADA Section 504 self <br /> assessments that had major changes and this will also apply county wide. There will be county <br /> wide training and will also include the county board. This nondiscrimination agreement is a <br /> standard agreement with the Nebraska Department of Roads. The Policy Statement is part of <br /> the agreement and any advertisements for work or services involving federal aid will have the <br /> new wording. There will also be poster that will be posted in every office and also Hall County <br /> Public Transportation. The discrimination procedure comes from the Nebraska Department of <br /> Road template including the complaint form and the procedures. . <br /> The County will also have to adopt a formal limited English Proficiency policy later. We will <br /> have to make sure that it is implemented and once a year the self assessment will need to be <br /> completed. <br /> Mr. Zitterkopf stated that on item 5 c he added the appointment of the Title VI coordinator. This <br /> seemed the logical place to start and also be able to rely on the committee to get through the <br /> process. <br /> Ms. Lancaster stated the Nebraska Department of Roads initiated this but a few years back they <br /> failed to comply with regulations and now they are leading this. Mr. Riehle stated all entities are <br /> to have a policy in place if we receive the federal funds. <br /> Mr. Zitterkopf stated that any funding that comes from the federal government and then to the <br /> State of Nebraska and then to the counties must comply. The document that has to be <br /> completed is a desk audit. Once it is completed it will be sent to the Nebraska Department of <br /> roads for them to review and sign. Mr. Riehle stated that all construction contracts will have to <br /> include the required wording. Mr. Zitterkopf stated that it is expensive to publish this as a legal <br /> notice so it will be posted on the web site to make it open to the public. <br /> 5 c) DISCUSSION &APPROVAL OF TITLE VI NONDISCRIMINATION AGREEMENT WITH <br /> NEBRASKA DEPARTMENT OF ROADS, INCLUDING APPOINTMENT OF HALL COUNTY <br /> 7 <br />
