<br />q~r-~~ <br />2. This resolution of temporary conditional use shall be <br />valid upon adoption by a majority vote of the members of the <br />Hall County Board of Supervisors and shall terminate upon <br />completion of Nebraska State Road proj~ct F28~-2 (101~) St. <br />Libory North and South or two years, wh~chever ~s earl~er. <br /> <br />3. Rubbish, trash, and debris shall not be stored or allowed <br />to accumulate upon the premises. <br /> <br />4. Equipment, rolling stock and vehicles shall not be stored <br />or parked within 60 feet of public road right of ways <br />adjacent to the premises. <br /> <br />~ <br /> <br />s. Owner shall comply with any and all applicable State and <br />Federal laws, and administrative rules and regulations <br />pertaining to air and water quality. Owner shall not use <br />the property in such a manner as to result in a nuisance to <br />adjoining landowners or the general public. <br /> <br />6. Owner shall comply with the Hall County Zoning Resolution <br />and Hall County Building Codes with respect to the use of <br />the above-described property. <br /> <br />7 . owner shall provide to the Hall County Public Works <br />Department a map on which is designated all county roads <br />which are or will be used as haul roads by owner, and <br />owner's subcontractors, vendors and vendees for transporting <br />equipment and materials to and from the above described <br />property, and shall keep such map continuously updated. <br />Throughout the term of this resolution and permit and upon <br />termination of the same owner shall keep, maintain, and <br />place said county haul roads in as good of condition as when <br />this resolution is adopted. Such maintenance shall include, <br />but shall not be limited to, the maintenance and repair of <br />asphalt road surfaces and the grading, graveling and control <br />of dust on non-paved roadways. <br /> <br />8. The rights and privileges granted herein may be <br />terminated for any act or acts on noncompliance with the <br />terms and conditions of this resolution. The Hall County <br />Board of Supervisors shall provide written notice to owner <br />of any act or acts constituting noncompliance. Owner shall <br />have 14 days to cure such noncompliance. In the event owner <br />fails to cure such noncompliance, the Hall County Board of <br />Supervisors may terminate or revoke the rights and <br />privileges granted herein. <br /> <br />9. Nothing in this resolution shall be construed as a grant <br />of right, authority, or privilege to permit or allow any use <br />of land, equipment, materials or methods which violate any <br />State or Federal law or any rule or regulation of any State <br />or Federal Administrative Agency. <br /> <br />10. The acceptance by owner of any benefit or right pursuant <br />to this resolution shall constitute owner's agreement to be <br />bound by the terms, conditions, and restrictions of this <br />resolution. <br /> <br />11. The rights, privileges, and obligations gran~ed by this <br />resolution shall not be assignable or transferable without <br />the written consent of the County of Hall, Nebraska. <br />
