That applicant seeks a conditional use permit authorizing the use of the above-descnoed real <br />estate for stock car racing, tractor pulling, motorcycle racing, buR riding, go-cart and monster truck <br />events open to public spectators. <br /> <br />b. That the above-described real estate is located in the AG-l Agricultural District. <br /> <br />c. That the Hall County Zoning Resolution provides that race tracks, drag strips and similar and <br />accessory uses are permitted conditional uses in the AG-l Agriculture Zoning District. <br /> <br />d. That adequate ingress and egress to the property exists or will be provided. <br /> <br />e. Adequate measures will be taken to minimi7.e the effects of noise and glare of the proposed <br />conditional use upon adjoining properties and properties generally in the district. <br /> <br />f That the proposed use, subject to the conditions and restrictions set forth herein., is generally <br />compatible with the use of adjacent properties and other properties in the area. <br /> <br />~ 2. A conditional use permit for the 40 acres in the Northwest Quarter of the Southwest Quarter <br />(NW~ SW ~) of Section Thirty-Four, Township Ten West, Range Nine North, of the 6th P.M., <br />Hall County, Nebraska, the approximate location of which is 2 ~ miles south of Interstate 80, on the <br />east side of South Locust Street, is granted to permit car racing, tractor pulling, motorcycle racing, <br />bull riding, go-cart and monster truck events open to public spectators under and subject to the <br />following terms and conditions: <br /> <br />a. That the conditional use of said premises shall be limited to car racing, tractor pulling, motorcycle <br />racing, bull riding, go-cart and monster truck events open to public spectators; <br /> <br />b. That there shall be provided upon said premises an area sufficient in size to accommodate 1,700 <br />parked vehicles, which area shall be properly graded and maintained; <br /> <br />c. That there shall be maintained along the north, south and west sides of the above descnoed <br />premises a border fence of at least five (5) feet in height with openings of not more than two inches <br />in width, said fence being for the primary purpose of retaining within the confines of the said 40-acre <br />area of all paper cups, wasted paper products from the concession stand, as well as other debris <br />resulting from gathering public spectators; <br /> <br />d. For the purpose of ingress and egress to and from the premises there shall be two roadways each <br />of at least 24 feet in width, which shall be maintained and located under the supervision of the Hall <br />County Public Works Director and that portion of said roadway from South Locu~ Street to the <br />property line of said 40 acre tract shall be surfaced with asphaltic concrete; - <br /> <br />e. Personnel shall be provided for traffic control during periods before, during and after races or <br />events and until traffic reverts to normal volume on and along South Locust Street, and such <br />personnel shall be in an adequate number to properly regulate traffic and keep the same moving in an <br />orderly, convenient and safe manner; <br /> <br />f All regulations of Hall County and the state of Nebraska with respect to plumbing, electricity, <br />building, health and safety as well as those which apply generally to endeavors of this nature shall be <br />adhered to as directed by appropriate authorities; <br /> <br />g. All track operations will be limited to weekends and holidays, except by permission of the Hall <br />County Board of Supervisors (weekend shall mean Friday night through Sunday night, inclusive, and <br />holidays shall mean Federal Holidays). Eight (8) additional racing days are permitted during racing <br />season without the permission of the Hall County Board of Supervisors; <br /> <br />h. Safety Regulations: <br /> <br />i All areas reserved for the viewing public, hereinafter referred to as the "spectator area," <br />shall be enclosed by fence so that the spectators will be unable to enter the track or pit areas; <br />ii. A retaining wall approved by the Hall County Building Inspector will be permanently <br />maintained in front of the spectator area, for a distance of at least 800 feet; <br />iii A chain-link steel fence will be maintained above the retaining wall at least six feet for the <br />entire distance of the retaining wall; <br /> <br />i. That within 24 hours following the conduction of activities upon the premises, all waste paper, <br />debris and trash as a result thereof shall be cleared and removed from that portion of South Locust <br />Street and its right of way abutting the premises on the west. <br />
