<br />96r-/tJ~ <br /> <br />y <br /> <br />Resolution # q~ - Of) IF <br /> <br />A Resolution Dedicating As a Public Park <br />Part of Lot Fifteen (15) on Island in the Southeast (SE) Quarter of Section One (1), <br />Township Nine (9) North, Range Eleven (11) West of the Sixth P.M., Hall County, <br />, Nebraska <br /> <br />WHEREAS, the County of Hall, Nebraska,is the owner of the following described real <br />estate, to wit: <br /> <br />Part of Lot Fifteen (15) on Island in the Southeast (SE) Quart~r of Section <br />One (1), Township Nine (9) North, Range Eleven (11 ) West of the Sixth <br />P.M., Hall County, Nebraska, and more particularly described as follows: <br /> <br />Commencing at a point Four Hundred Forty-Five and Thirty-Four <br />Hundredths (445.34) feet north of the Southeast (SE) Corner of said <br />Section One (1), said point to be the meander corner along the north bank <br />of the main channel of the Platte River; thence continuing north 00 00' on <br />the easterly line of said Section One (1) a distance of Five Hundred Thirty <br />and Twenty-Seven Hundredths (530.27) feet; thence southwesterly 570 <br />51' 36" along the northerly right of way of county road, a distance of One <br />Thousand Three Hundred Forty-Five and Seventy-One Hundredths <br />(1345.71) feet, to a point on the southerly line of said Lot Fifteen (15) on <br />Island, thence southeasterly 880 15' 36" a distance of Fifty-Three and <br />Fifty-Eight Hundredths (53.58) feet to a point being the meander corner <br />along the north bank of the Platte River; thence northeasterly 800 12' <br />59.2" a distance of One Thousand One Hundred One and Ninety-Six <br />Hundredths (1101.96) feet to the point of beginning and containing 7.071 <br />acres more or less, plus all accretions thereto; and <br /> <br />WHEREAS, said real estate was purchased by the County of Hall for the purpose of <br />providing replacement park ground for that portion of George Clayton Park which is <br />anticipated to be converted from park use to flood control use as part of the proposed <br />Wood River Diversion Project; and <br /> <br />WHEREAS, dedication of said real estate is necessary to qualify real estate as <br />replacement park land pursuant to the rules and regulations of the Nebraska Game and <br />Parks Commission and the Unites States Parks Service; and <br /> <br />WHEREAS, it is in the best interests of the County of Hall that the aforedescribed real <br />property be dedicated a public park and that the Chairman of the Hall County Board of <br />Supervisors and the County Clerk be authorized to execute such documents and <br />agreements as necessary in order to qualify said real estate as replacement park land <br />for the purposes abov,e-described. <br /> <br />NOW BE IT RESOLVED by the Hall County Board of Supervisors that the above- <br />described real estate be hereby dedicated a public park to be used by the County of <br />Hall as a public park and pleasure ground and for the purpose of amusement and <br />recreation, to be enjoyed for these purposes by the public generally, subject to the <br />authority of the Hall County Board of Supervisors to govern, regulate, improve, and <br />operate said park individually or in combination with any other p'olitical or governmental <br />subdivision, or with any agency, or public corporation, whether federal, state, or local, <br />or with any number or combinations thereof, as permitted by Neb.Rev.Stat. sec. 13-304 <br />et seq. <br /> <br />BE IT FURTHER RESOLVED that the Chairman of the Hall' County Board of <br />Supervisors and the Hall County Clerk be and are hereby authorized to execute for and <br />on behalf of Hall County such amendments to the agreement between the County of <br />Hall and the Nebraska Game and Parks Commission, a copy of which is attached <br />hereto, and such other documents as necessary in order to carry out and effectuate this <br />Board's intent that the aforesaid real estate be qualified as replacement park land as <br />set forth above. <br />
