Landis made a motion which was seconded by Abernethy to refer the bids to the Public Works Committee and Director. Quandt, Landis, Hartman, Stelk, Leslie, Abernethy, and Rosenkotter voted yes and none voted no. Motion carried. 't' . 10:15 a.m. Break 10:23 a.m. Meeting resumed with Quandt, Landis, Stelk, Leslie, Abernethy, and Rosenkotter present. Janulewicz reported on the question regarding Roberts Rules of Order. He said the motion to rescind must be made by a person who voted on the prevailing side of the original motion. Janulewicz said it appears the original motion to reconsider the prior action was null because the person who made the motion wasn't on the winning side of the prior action. He said there was no valid motion to second so the Board can't proceed with that motion or call for the question on it. Hartman returned at 10:24 a.m. (CONTINUED)CONSERVATION EASEMENT AND ZONING OVERLAY: The issue was further discussed. Denzel Busick explained the conservation easement statute. There was discussion on the proposed interlocal agreement. Hostler answered questions regarding the funding reimbursement for the environmental impact statement. Busick answered questions regarding similar easements at other interchanges. Quandt made a motion which was not seconded to place this issue on the agenda in two weeks (February 27). Rosenkotter said'the Board members have had the proposal for at least two weeks. Landis proposed putting the issue to a vote by the entire county on the primary ballot at no cost and said the question must be to the Election Commission by March 1. Th~ issue was discussed. Rosenkotter made a motion which was seconded by Abernethy to place the interlocal agreement on the agenda for February 20. The issue was discussed. Quandt and Hartman voted no and Landis, Stelk, Leslie, Abernethy, and Rosenkotter voted yes. Motion carried. Hartman left the meeting.
