<br />Quandt, Chairman of Parks Committee spoke in regard to the emergency repairs
<br />qnd reasons for need to be done as soon as possible. Discussion followed and
<br />Landis Committee member felt should be declared an emergency and pay for the
<br />repairs from Inheritance fund.
<br />Motion by Hartman, seconded by Quandt to proceed with repairs requested as
<br />soon as possible and declare emergency to pay from Inheritance fund and to
<br />accept the low proposal received from Heartland Electric for $5750.00.
<br />Abernethy, Hartman, Lancaster, Landis, Long, Quandt and Stelk voted yes, none
<br />voted no. Motion carried.

<br />RESOLUTION #97-0028 PROVIDING RULES AND" REGULATIONS FOR LAND APPLICATION OF
<br />PAUNCH MANURE. Report on the committee meeting and stated the resolution is
<br />same as one adopted May 1996, except Health Department has been changed to
<br />Building Inspector and change on page 4 003.01J. Discussion followed.
<br />Motion by Stelk, seconded by Quandt to adopt Resolution #97-0028 on the
<br />update of rules and regulations. Abernethy, Hartman, Lancaster, Landis,
<br />Long, Quandt and Stelk voted yes, none voted no. Motion carried.

<br />A RESOLUTION PROVIDING RULES AND REGULATIONS FOR
<br />LAND APPLICATION OF PAUNCH MANURE
<br />
<br />WHEREAS, the Hall County Board of Supervisors desires to regulate the land application of
<br />paunch manure in order to promote the public health, safety, and welfare and to prevent and abate
<br />nuisances, including the pollution of air, land, and water, within the County ofHa11.
<br />
<br />NOW, THEREFORE, BE IT RESOLVED by the County Board of Supervisors of Hall County,
<br />Nebraska, that the following rules and regulations are hereby adopted, regulating the land
<br />application of paWlch manure within the Wlincorporated areas of the County except those areas
<br />where a city or village has been granted zoning jurisdiction and is exercising such jurisdiction:

<br />Chapter 1 - DEFINITIONS.
<br />
<br />Unless the context otherwise requires:
<br />
<br />QQl "Application rate" means the concentration of the paWlch manure administered to the soil.
<br />
<br />QQ2. "Best Management Plan" means a plan which describes Best Management Practices intended
<br />to prevent or minimize the potential for pollution of waters, air or land of the state and to prevent
<br />or minimize health problems resulting from the operation.
<br />
<br />QQl "Best Management Practices (BMP's)" means treatment requirements, operating and
<br />maintenance procedures, schedules of activities, prohibitions of activities, and other management
<br />practices to control site runoff, spillage, leaks, sludge or waste disposal or drainage from raw
<br />material or waste storage.
<br />
<br />QQl "Container" means any device, excluding a lagoon, in which a material is stored, transported,
<br />treated, disposed of, or otherwise handled.
<br />
<br />Q!M. "Crop" means a plant or plant product grown for harvest, including grazing by domesticated
<br />livestock.
<br />
<br />QQ5. "Pamch manure application site" means land where pamch manure materials are applied.
<br />
<br />QQ6. "Department" means the Office of the Hall County Building Inspector.
<br />
<br />001 "Dewatering" means the process of removing water from pamch manure.
<br />
<br />Q.Q.S. "Director" means the Hall County Building Inspector.
<br />
<br />002. "Discharge," when used without qualification, means a discharge of a pollutant and a
<br />discharge of pollutants.
<br />
<br />Q.1.Q. "Discharge of a pollutant" and "discharge of pollutants" each means any addition of any
<br />pollutant or combination of pollutants to waters of the state from any point or nonpoint source.
<br />This includes dischame into waters of the state from surface runoff which is collected or channeled
<br />by man or discharges through pipes, sewers, or other conveyances, owned by a state, m1.U1icipality
<br />or other party which do not lead to treatment systems.
<br />
<br />ill "Dry ton" means a theoretical weight of 2000 pOWlds of material at 0% moisture used in
<br />calculating an actual amount of material for land application or other purposes.
<br />
<br />ill "Generator" means any person, by site, whose act or process produces pamch manure.
