<br />q~<<-~LI 05 <br /> <br />public interest, and that said Board is empowered under the Zoning Resolution to grant said <br />Conditional Use; and <br />.WHEREAS, The Board finds that compliance with the specific rules governing <br />individual conditional uses will be satisfied by compliance with the conditions contained herein <br />and set forth below. <br />NO\V THEREFORE, pursuant to the powers granted under the Zoning Resolution as <br />adopted by the Board of Supervisors of Hall County, Nebraska, the Hall County Board of <br />Supervisors, hereby grants to Nitro Construction, their successors, assigns, grantees and licensees <br />a Conditional Use Permit on the above described real estate for the purpose of the mining and <br />pumping of sand and gravel from the land only for a period of ten (10) years beginning the 22nd <br />day of December, 1995, SUBJECT TO the following conditions, restrictions and obligations <br />which are made a part hereof and are set out hereafter; <br />(A) All trees, rubbish and debris must be completely cleared from the above described <br /> <br />real estate as soon as practical and said real estate must, at all times, be kept in a clean and neat <br />condition as to be presentable to the general public. <br />(B) No trash, rubbish, debris, broken concrete, dead trees, lumber, bricks, refuse or junk <br />material of any nature whatsoever may be dumped, placed or located in the proposed area for the <br />mining and pumping of sand and gravel. <br />(C) No uses under the Conditional Use Permit shall result in unreasonable air pollution <br />which creates an unreasonable hazard or nuisance to the adjacent landowners or to the general <br />public. The permittee shall at all times work in consultation with the State of Nebraska <br />Department of Health and Human Services Division of Environmental Health in order to prevent <br />unreasonable air pollution and prevent any unreasonable hazard or nuisance to the adjacent <br />landowners or the general public. <br />(D) Any and all drainage ditches which may be located in the real property subject to this <br />Conditional Use Permit shall be maintained and kept open by permittee. <br />(E) Permittee, Nitro Construction, neither directly by itself or indirectly by leasing or hire <br />shall permit the hauling of sand and gravel from the premises and over and across any public <br />highways or roads whether they be hard surfaced or not, unless: <br /> <br />(a) Said sand and gravel is completely dry and free of <br />water; or <br /> <br />I <br /> <br />.' <br /> <br /> <br />r <br />It <br />f <br /> <br />
