q~i=Gl[3Y (b) Said sand and gravel is hauled in trucks which are so equipped as to prevent water flowing from said sand and gravel directly onto the travelable portion of said roadway, either by containing water within the truck box or by concentrating such water and directing its flow by trough or other method of the roadway and directly into the barrow pit or road ditch. (F) All water accumulated upon the premises by virtue of such mining and pumping operations shall be retained thereon to such an extent the same shall not flow upon or encroach upon any adjacent land. Only surface waters which have historically flowed from the premises shall be allowed to leave the same through any natural drainage areas. The term ofthe'Conditional Use Permit shall be for a period often years (10) beginning the 22nd day of December, 1998, the date of the granting hereof, but may be terminated, revoked and ended if the permittee fails to comply with any of the conditions, restrictions and obligations set forth, provided that if any violation comes to the attention of the Hall County Board of Supervisors, the Hall County Board of Supervisors may notify the permittee in writing setting forth the specific area of noncompliance. lfthe permittee fails to take reasonable action to comply with the notice of noncompliance and correct any or all violations within 30 days after receiving said notice, the Hall County Board of Supervisors may hold a hearing to consider the revocation and termination of the Conditional Use Permit by a majority vote. Nothing in this grant of Conditional Use Permit shall be construed as a grant of right, authority or permit to allow any use ofland, materials or methods with violate any state or federal law or rule or regulation of a federal, state or local agency other than as specifically set forth herein.
