The Tax
Equalization and Review Commission ordered the increase on
grassland and irrigated land at the May 15 show cause hearing and
the county did not take any action at that time, so the
commission told the County that they could not make any changes
now. Janulewicz provided information to the board members on
the court of appeal process. Janulewicz stated that the board
could try to appeal the TERC decision but they maintain that once
an order is issued it stands. The board members that had
attended the petition hearing ask about transcripts of the
hearing and were told it would cost $125.00 an hour for the
transcriptions.

LETTERS TO PROTESTOR ON TERC APPEAL PROCESS: Hartman stated he
wants to send letters to the people who filed a protest informing
them of the appeal process to TERC. Janulewicz stated that once
the appeal is filed with TERC the County could offer to confess
judgement on specific cases. The appeal hearings are held in
Grand Island. If an appeal is approved the taxes would be
reduced and a refund ordered. Janulewicz provided a copy of the
letter. The letters would be mailed to all of the 1234
protestors. Stelk made a motion and Lancaster seconded to send
a letter to all the taxpayers who filed a protest. Abernethy,
Hartman, Lancaster, Landis, Long, Quandt and Stelk all voted yes
and none voted no. Motion carried.

10:00 A.M.
