'F19990199 WHEREAS, the Hall County Board of Supervisors finds it is in the best interests of all citizens and residentS of the County of Hall to proceed with improvements to South Locust Street and the construction of an interchange at Interstate 80. NOW BE IT RESOL YED AS FOLLOWS: . 1. The July 5, 1994 motion which provided that the conservation easements shall not be acquired through the process of eminent domain for the South Locust Street Interchange Project be hereby rescinded. 2. The County of Hall shall propose an amendment to the interlocal agreement providing for the acquisition of conservation easements by eminent domain in the event negotiations between the project negotiators and the affected landowner or landowners reach impasse, with the costs of acquisition of conservation easements including, but not limited to, legal costs and expenses, court costs, attorney fees, damage awards and settlements awards, less federal highway funds, shall be equally divided between the County and the City. The Hall County Attorney is directed to prepare a proposed agreement amending the interlocal agreement and the Chairman of the Hall County Board of Supervisors is authorized and directed to execute the same in the name of and on behalf of the County of Hal!. 3. Upon approval of the proposed amendment to the interlocal agreement by the City, the NDOR and the NGPC, the Hall County Attorney, or such other counsel as may be retained by the county for this purpose, is authorized and directed to commence eminent domain proceeding to acquire any necessary right-of-way or conservation easement for the project if negotiations between the county's agents and the landowner or interested party reaches impasse.
