<br />F19990193 <br /> <br />CONSIDER AND ADOPT RESOLUTION RESCINDING ACTION REGARDING <br />CONSERVATION EASEMENT ON SOUTH LOCUST PROJECT: This resolution <br />will rescind the action taken in 1994. Arnold made a motion and <br />Logan seconded to approve Resolution #99-0030 to rescind the <br />action taken on July 5, 1994 not to condemn property for the <br />conservation easements on the South Locust project. Deputy <br />County Attorney Jerry Janulewicz reported the following status on <br />the 10 properties that include conservation easements: <br />4 counter offers have been received <br />3 received counter offers that may be accepted <br />2 offers have not been accepted and may need to <br />use eminent domain proceedings <br />1 property owner has not provided any documentation at all <br />There may be 3 properties that eminent domain may be necessary. <br />Arnold, Jeffries, Lancaster, Landis, Logan and Stelk all voted <br />yes and Hartman abstained. Motion carried. <br /> <br />RESOLUTION # Cl C, - () ().30 . <br /> <br />A RESOLUTION RESCINDING THE ACTION TAKEN ON JULY 5,1994, THAT <br />CONSERVATION EASEMENTS NOT BE ACQUIRED THROUGH THE PROCESS OF <br />EMINENT DOMAIN FOR THE SOUTH LOCUST STREET INTERCHANGE <br />PROJECT. <br /> <br />WHEREAS, on July 5, 1994, the Hall County Board of Supervisors adopted a motion that <br />conservation easements shall not be acquired by the County through the process of eminent <br />domain for the South Locust Street Interchange Project; and <br /> <br />WHEREAS, on February 20, 1996, the Hall County Board of Supervisors approved an <br />interlocal agreement (interlocal agreement) entered by and between the County of Hall (County), <br />the City of Grand Island (City), the Nebraska Department of Roads (NDOR) and the Nebraska <br />Game and Parks Commission (NGPC) pertaining to the preservation of wildlife habitat and buffer <br />areas, through the acquisition of conservation easements, as a necessary part of the improvements <br />to South Locust Street and the construction of a interstate interchange at South Locust street and <br />Interstate 80; and <br /> <br />WHEREAS, the acquisition of conservation easements for the preservation of wildlife <br />habitat and buffer areas will preserve objects of attraction or scenic value adjacent to, along or in <br />close proximity to South Locust Street and the culture of trees and flora which may increase the <br />scenic beauty South Locust Street; and <br /> <br />WHEREAS, the County of Hall, through its negotiators, has been unsuccessful in <br />obtaining the necessary conservation easements through good faith negotiations with the effected <br />parties; and <br /> <br />WHEREAS, continued participation and funding by the Federal Highway Administration <br />in the urban and rural portions of the South Locust Street Project is dependent upon acquisition <br />of conservation easements as provided in the Record of Decision issued at the conclusion of a <br />study of the environmental impact of the project; and <br />
