<br />WHEREAS owner has made a written application to use the above-described property for the <br />erection and operation of a portable asphalt mixing plant to be used for the manufacture of paving <br />material for State of Nebraska Department of Roads project EACIM:-80-6(58), 1-80 Between Wood <br />River and Grand Island; and <br /> <br />F199901%9 <br />WHEREAS a public hearing on said application was held on April 13, 1999, by the Hall <br />County Board of Supervisors following due and proper notice; and <br /> <br />WHEREAS, the Hall County Zoning Resolution permits the authorization of a non conforming <br />conditional use for a period not to exceed two years. <br /> <br />NOW, BE IT RESOLVED that the application of owner for a temporary conditional use of the <br />above-described property is hereby granted subject to the following conditions, <br /> <br />I. That owner may erect and operate a portable asphalt mixing plant upon said property, said <br />plant to be used for the manufacture of road paving material for the above-described projects. <br /> <br />2. This resolution of temporary conditional use shall be valid upon adoption by majority vote of <br />the members of the Hall County Board of Supervisors and shall terminate upon completion of State of <br />Nebraska Project EACIM:-80-6(58), 1-80 Between Wood River and Grand Island or two years, <br />whichever is earlier. <br /> <br />3. Rubbish, trash, and debris shall not be stored or allowed to accumulate upon the premise. <br /> <br />4. Equipment, rolling stock and vehicles shall not be stored or parked within 60 feet of pubic road <br />right of ways adjacent to the premises. <br /> <br />5. Owner shall comply with any and all applicable State and Federal laws, administrative rules, <br />and regulations pertaining to air and water quality; owner shall not use the property in such a manner as <br />to result in a nuisanc.e to adjoining landowners or the general public. <br /> <br />6. Owner shall comply with the Hall County Zoning Resolution and County Building Codes with <br />respect to the use of the above-described property. <br /> <br />7. Throughout the term of this permit and upon its completion the owner shall maintain all county <br />roads used for haul roads by owner, its subcontractors, vendors and vendees in transporting equipment <br />and materials from the above-described property to the locations of the above-named road projects. <br />Such maintenance shall include, but shall not be limited to, the maintenance and repair of asphalt road <br />surfaces; grading, graveling and controlling dust on non-paved road surfaces; and repair of surface and <br />grade irregularities in proximity to roadway bridges. <br />
