No uses under this resolution shall result in an unreasonable hazard or nuisance to the <br />adjacent landown~rs or to the general public. <br /> <br />3. Nothing in this grant of conditional use shall be construed as a grant of right, authority or <br />permit to allow any use of land, materials or methods which violate any state or federal law <br />or rule or regulation of a federal, state or local agency other than as specifically set forth <br />nerem. .1 ne applIcant shall be reqUIred, as a condition of this permit, to comply with all <br />applicable state and federal laws and regulations including, but not limited to, those <br />pertaining to telecommunications, water quality, surface drainage, flood control and <br />protection, and environmental quality and protection. Applicant shall at all times comply <br />with any and all tower marking and illumination requirements of the Federal Aviation <br />Administration and the Federal Communications Commission. <br /> <br />4. The term of this conditional use permit shall be for a period of ten (10) years beginning the <br />date hereof, but may be terminated if applicant fails to comply with any of the conditions, <br />restrictions and obligations set forth herein. In the event of noncompliance, the Hall County <br />Board of Supervisors shall notify the applicant in writing setting forth the specific area or <br />areas of noncompliance. If the applicant fails to cure any such noncompliance within 30 <br />days after receiving said notice, the Hall County Board of Supervisors shall hold a hearing to <br />consider the suspension, revocation, or termination of this permit of conditional use. <br /> <br />5. Applicant shall erect, construct, operate, and maintain said microwave telecommunications <br />tower and relat~d structures in accordance with applicant's application for conditional use and <br />in accordance with applicable Hall County Building Codes. <br /> <br />6. The above-described lands shall be restored to their original condition should the tower be <br />removed. <br /> <br />7. The above-described tower and appurtenances shall be maintained in good condition and <br />reparr. <br /> <br />8. In the event the use of the tower ceases for a period of 365 consecutive days the tower shall <br />be deemed to be abandoned and the tower owner shall dismantle and remove the same within <br />75 days of such abandonment. <br /> <br />9. Access to the public road right of way shall be by a private drive, constructed by applicant at <br />applicant's expense, which shall provide for drainage along and through the county road ditch <br />by means of a 30 inch by 24 foot round culvert or by a 35 inch by 24 inch oval culvert 25 feet <br />in length. The drive shall be surfaced with road rock or gravel to provide access during <br />inclement weather. Said culvert shall be installed at such grade and in such manner as <br />directed by the Director of the Hall County Public Works Department. <br />10. Applicant shall permit the reasonable use of the tower by the County of Hall for public <br />purposes if such use can be reasonably accommodated by the Applicant, that such use <br />complies with FCC regulations, and does not create or cause interference for other users of <br />the tower. <br /> <br />This Conditional Use Permit is hereby granted thi~3 day of February, 1999, subject to <br />the terms, conditions and restrictions above set forth. <br />
